The
following terms and phrases, as used in this article, unless the context
clearly shows otherwise, shall have the following meanings:
Applicant.
The person that applies for a certificate hereunder.
Certificate.
A permit, in the form of a certification of a registration
certificate, authorizing the operation of a wrecker service for the
purpose of making police pulls within the city.
Chief.
The chief of public safety of the city.
Consent tow.
The removal of a vehicle from a public street or place, at
the request of the owner, operator or person otherwise in charge of
the vehicle, to a place of repair or storage.
Disabled vehicle.
A vehicle which has been rendered unsafe to be driven as
the result of some occurrence other than a wreck, including, but not
limited to, mechanical failures or breakdowns, fire, or vandalism,
or a vehicle which is in a safe driving condition, but the owner is
not present or able or permitted to drive so as to reasonably necessitate
that the vehicle be removed by a wrecker.
Junked vehicle.
Shall have the same meaning provided a junked vehicle in section
8.05.002 of the Code of Ordinances, City of Dalworthington Gardens, Texas.
Nonconsent tow.
The removal of a vehicle from a public street or place, without
the consent of the owner, operator or person otherwise in charge of
the vehicle, to a place of storage.
Police pull.
A nonconsent tow ordered by an officer of any law enforcement
agency having jurisdiction within the city.
Tow truck.
A tow truck, as defined in V.T.C.A., Occupations Code sec.
2308.002.
Wrecked vehicle.
A vehicle that has been damaged as the result of overturning
or colliding with another vehicle or object so as to reasonably necessitate
that the vehicle be removed by a wrecker.
Wrecker.
A tow truck, as defined in V.T.C.A., Occupations Code, sec.
2308.002.
Wrecker service.
A towing company, as defined in V.T.C.A., Occupations Code
sec. 2308.002.
