Safety controls and regulations are required when work zones obstruct the normal flow of traffic and/or block roadways. The safety of the workers in such work zones is enhanced with the safe and expeditious movement of traffic through the work zones.
Any person, contractor, or public utility wishing to conduct work on, under, or above the roadway shall comply with the following:
A. 
Contact the Traffic Bureau of the Bordentown Township Police Department to arrange a preconstruction meeting. Plans must be submitted for the safe movement of traffic through the work zone.
B. 
Provide the Traffic Bureau of the Police Department with at least two emergency contact numbers.
(1) 
The Traffic Bureau of the Police Department may take action to correct a hazardous condition if the emergency contact does not respond or cannot be reached to correct the hazardous condition.
(2) 
The reasonable fees for emergency service to correct hazardous conditions shall be charged to the person, contractor, or public utility responsible for such hazardous conditions.
There shall be no construction maintenance or utility work on any roadway before 9:00 a.m. or after 4:00 p.m. Adjustments to such hours may be made by the officer in charge of the Traffic Bureau of the Police Department. Such adjustments shall not be permitted if traffic would be substantially delayed or cause safety and/or health hazards.
Road closings and/or detours due to work zones shall not be permitted unless approved by the Traffic Bureau of the Police Department.
Traffic directors shall be posted at all work zones when deemed necessary by the Traffic Bureau of the Police Department.
In order to abate any nuisance and/or safety hazard, or for any violation of this chapter, the Traffic Bureau of the Division of Police shall have the authority to stop work in any work zone, which includes the removal of the following:
A. 
Equipment and vehicles;
B. 
Stored material within the street right-of-way;
C. 
Backfilling of open excavations and/or other related work.
No materials, vehicles, or equipment shall be placed in the roadway or sidewalk area until all construction signs, lights, devices, and pavement markings are installed.
Any person, contractor, or utility that violates this section shall, upon conviction thereof for a first offense, pay a fine of not less than $1,000 nor more than $5,000, and/or be imprisoned for a term not exceeding 90 days. For a second offense, upon conviction thereof, the guilty party shall pay a fine not less than $1,250 nor more than $5,000, and/or be imprisoned for term not exceeding 90 days.
Continuation of a violation for each successive day shall constitute a separate offense.
