No motor vehicle which does not bear a current certificate of inspection and valid registration plate as required by the state of residence of the motor vehicle owner shall remain on, be parked on or stored on any street or in any right-of-way for a period in excess of 15 cumulative days in any one calendar year. A motor vehicle that may be registered as another conveyance shall be considered a motor vehicle for the purposes of this Article VIII.
Except for trucks and trailers loading or unloading equipment or merchandise and only for the time necessary to load or unload, no trailer of any size or type, all-terrain vehicle, mini-bike, snowmobile, boat, bus, recreational vehicle, motor home, truck-camper, truck or motor vehicle in excess of 10,000 pounds gross vehicle weight rating, major component parts, large vehicle or boat components (including but not limited to engines, transmissions, axle housings, frames or bodies) or device of any kind in, upon or by which any person or property is or may be transported or drawn (other than those vehicles permitted by § 154-18A of this Chapter 154) shall be parked or stored on any street or in any right-of-way.
If lawfully parked or stored outside on private property, all motor vehicles, trailers and other vehicles and conveyances described in §§ 154-54 and 154-55 shall be parked or stored only on an impervious surface and in a location in compliance with applicable law.
The prohibitions on parking or storage of vehicles in excess of 10,000 pounds gross vehicle weight rating and trailers shall not apply to emergency service vehicles responding to emergency calls, utility service vehicles (e.g., electric, gas, cable) providing service to an adjacent property and vehicles owned or operated by Pennsbury Township or any other governmental entity.
Any violation of the provisions of this article is hereby declared a nuisance.
The Township Manager or his/her designee shall notify any person in violation of this article of the nature of the violation and require compliance with this article within 15 days of the date of the notice. The notice shall be affixed to the motor vehicle, vehicle component or other item (if located on the street or right-of-way) in a conspicuous place and shall be given by mailing a notice to the owner of the vehicle, vehicle component or item, if known, and to the name and address of the owner of the private property where the violation is occurring, by regular mail, postage prepaid. If the person so notified does not comply in accordance with the notice within 15 days of the date of the notice, the Township may proceed to abate such violation by removing the vehicle, vehicle component, or other item. The removal and impoundment of vehicles shall be in accordance with the requirements and restrictions of Article IV of Chapter 154 of the Code of the Township of Pennsbury. Neither the Township nor any of its officers, employees or contractors shall be held responsible for any damage to any vehicle, vehicle component or other item or real or personal property occurring as a result of towing and/or removal of a vehicle, vehicle component or other item parked or stored in violation of this article. The cost of the towing or removal shall be charged and collected from the person in violation in a manner provided by law, including the filing of a municipal lien or claim against the property where the violation occurred. The recovery of such cost and expense shall be in addition to the penalty imposed as provided in § 154-60 of this article.
If the person so notified does not abate the violation in accordance with § 154-59, the Township may bring a summary criminal action against the person in violation, and, upon conviction thereof before a District Justice, the defendant shall be sentenced to pay a fine of not less than $100 and not more than $1,000 and costs of prosecution and, in default of the payment of such fine and costs, shall be imprisoned in the county jail for a period of not more than 30 days. This article may also be enforced by the Township by an action in equity.
