(a) Restricted.
It shall be unlawful to offer for sale or
to sell any alcoholic beverage, intoxicating liquors, wine or beer
for on-premises consumption at any place within the corporate limits
except at a restaurant located within the area zoned “commercial.”
The term “restaurant” shall mean a place which is regularly,
and in a bona fide manner, used and kept open for the serving of food
to guests for compensation, which has suitable seating facilities
for preparing food and serving an assortment of foods commonly ordered
at various hours of the day or night, and whose primary business is
serving food. The term “primary business” means that the
gross sales of food shall exceed sixty (60) percent of such business’s
gross sales.
(b) Penalty.
Upon conviction, violators will be punished as provided in section
1.01.009 of this code.
