An inconsistent, disapproved, or noncompliant SWM site plan
may be resubmitted with the revisions addressing the Borough Engineer's
concerns or comments documented in writing. It must be addressed to
the Borough Manager as if the plan was an original submission, distributed
accordingly, and be subject to review as if the plan was an original
submission. The applicable Borough review and inspection fee(s) and/or
required escrows must accompany a resubmission of an inconsistent
or noncompliant SWM site plan.
The Borough's approval of a SWM site plan shall be valid
for a period not to exceed five years commencing on the date that
the Borough signs the approved SWM site plan. If stormwater management
facilities included in the approved SWM site plan have not been fully
constructed, or if fully constructed, record drawings of these facilities
have not been approved within this five-year time period, then the
Borough may consider the SWM site plan inconsistent or noncompliant
and may revoke any and all permits if the facilities are not in compliance
with the current Borough laws and regulations. SWM site plans that
are determined to be inconsistent or noncompliant by the Borough may
be revised to show compliance and then resubmitted in accordance with
this chapter.
