As used in this article, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE
Any motorized off-highway device designed to travel primarily off-highway, 50 inches or less in width, having a manufacturer's drive weight of 1,500 pounds or less, traveling on three or more non-highway tires, designed with a seat or saddle for operator use, and handle bars or steering wheel for steering control, except equipment such as lawn mowers (65 ILCS 5/1-101.8).
LOT or LOTS
A lot which is located in the Village of Morrisonville, Christian County, Illinois.
OFF-HIGHWAY MOTORCYCLE
Any motorized device designed to travel primarily off-highway on two wheels, having a seat or saddle for the use of the operator, upon or by which any person, persons, or property may be transported or drawn (625 ILCS 5/1-153.1).
RIDING AREA
The area on a lot used by an all-terrain vehicle or off-highway motorcycle.
The use of off-highway motorcycles and/or all-terrain vehicles shall be allowed on owner-occupied residential lots plus one adjoining lot if owned by the owner of the lot where the residence exists.
The operation/use of an off-highway motorcycle and/or all-terrain vehicle shall adhere to the following:
A. 
An off-highway motorcycle and/or all-terrain vehicle must have a federally approved spark arrestor, the noise emission may not exceed 99 decibels at a distance of 20 inches at idle and mufflers may not be altered to increase motor noise, or have a cut out bypass, or similar device.
B. 
Only household members and immediate family members shall be allowed to operate an off-highway motorcycle and/or all-terrain vehicle on the property otherwise set forth herein. "Immediate family" is defined for the purposes of this chapter as a household husband, household wife, and natural, and/or adopted, children of the household parents.
C. 
The operation/use of off-highway motorcycles and/or all-terrain vehicles shall only be allowed during the following times, said times being in full force and effect Monday through the following Sunday:
(1) 
9:00 a.m. to 11:00 a.m.
(2) 
2:00 p.m. to 5:00 p.m.
(3) 
7:00 p.m. to dusk.
D. 
The operation/use of off-highway motorcycles and/or all-terrain vehicles shall not be allowed on either primary or secondary septic sites.
E. 
Any established riding area must be watered down before, during, and after usage as needed to limit dust.
F. 
No riding area shall be designed or operated to allow excessive standing water. "Excessive standing water" is defined as standing water on the riding area which exists more than 48 hours after the cessation of rain provided that no raining takes place during the 48 hours.
The following uses are exempt from this chapter:
A. 
Any off-highway motorcycle and/or all-terrain vehicle used by the Village or any other governmental body in conducting official business.
B. 
Any off-highway motorcycle and/or all-terrain vehicle used for the purpose of lot maintenance.
Any person who violates any provision of this article shall be fined pursuant to the general penalty chapter in Chapter 1, Article III, General Penalty, of the Village Code.

For the purpose of this article, the following words and terms used in this article shall have the meanings respectively ascribed to them in this section:
GOLF CART
A vehicle specifically designed and intended for the purposes of transporting one or more persons and their golf clubs or maintenance equipment while engaged in the playing of golf, supervising the play of golf, or maintaining the condition of the grounds on a public or private golf course (625 ILCS 5/1-123.9). A golf cart is further defined as a "non-highway" vehicle, as set forth in 625 ILCS 5/11-1426.1.
STREETS AND ROADWAYS UNDER THE JURISDICTION OF VILLAGE OF MORRISONVILLE
All those streets and roadways located within the corporate boundaries of the Village of Morrisonville, Illinois, and under the jurisdiction of the Village of Morrisonville, Christian County, Illinois.
VILLAGE
The Village of Morrisonville, Christian County, Illinois.
No person shall ride, drive, or operate any golf cart on any roadway or street located within corporate limits of the Village of Morrisonville, Illinois, except as specifically set forth herein.
No golf cart shall be operated on the Village of Morrisonville streets or roadways unless it is inspected and issued a permit from the Village of Morrisonville. The Chief of Police, and/or his designee, shall be in charge of the inspection. The golf cart being inspected must meet the specifications as set forth in 625 ILCS 5/11-1426.1(e). Those requirements are as follows:
A. 
No non-highway vehicle (golf cart) may be operated on a roadway unless, at a minimum, it has the following: Brakes, a steering apparatus, tires, a rear view mirror, red reflectorized warning devices in the front and rear, a slow moving emblem (as required of other vehicles in 625 ILCS 5/12-709) on the rear of the non-highway vehicle golf cart, a headlight that emits a white light visible from a distance of 500 feet to the front, a tail lamp that emits a red light visible from at least 100 feet from the rear, brake lights, and turn signals. When operated on a street or roadway within the Village of Morrisonville, the golf cart shall have its headlights and tail lamps lighted as required by 625 ILCS 5/12-201, entitled "When Lighted Lamps are Required."
B. 
The permit (sticker form) must be displayed openly on the front left side fender of the golf cart. Anyone obtaining a golf cart permit shall pay a fee per calendar year in an amount set from time to time by the Board of Trustees.

Any person who drives or is in actual physical control of a golf cart on a roadway as otherwise set forth herein while under the influence is subject to 625 ILCS 5/11-501 through 625 ILCS 5/11-502 of the Illinois Vehicle Code.
Every golf cart operated as authorized in this article shall comply with any and all traffic regulations found in Chapter 625 ILCS 5/1-1 et seq.
Any person who operates a golf cart as otherwise set forth herein shall be subject to the mandatory insurance requirements under Article 6 of Chapter 7 of the Illinois Vehicle Code (625 ILCS 5/7-601 et seq.).
Golf carts shall only be allowed to be operated on those streets and roadways located within the corporate jurisdiction of the Village of Morrisonville and upon which the Village of Morrisonville has jurisdiction of those streets and roadways.
This chapter shall not be deemed to authorize any other non-highway vehicles as defined in 625 ILCS 5/11-1426.1, to be operated on any street or roadways within the corporate boundaries of the Village of Morrisonville upon which the Village of Morrisonville has jurisdiction. [All-terrain vehicle, neighborhood vehicle, off-highway vehicle, utility vehicles (UTV).]
The Street Superintendent shall cause appropriate signs to be posted on those streets and roadways where golf carts are authorized to be operated pursuant to this article and the state statute referenced herein.
No person shall operate a golf cart upon any sidewalk located within the jurisdictional limits of the Village of Morrisonville. The operation of golf carts within the Village of Morrisonville, Christian County, Illinois, will be allowed both in the daytime and after dark.
Golf carts as used in this section shall not make a direct crossing upon or across any toll road, interstate highway, or controlled access highway in the street. Notwithstanding the above, golf carts as stated in this article shall be allowed to cross the state highway, municipal street, county highway, or road district highway if the operator of the golf cart makes a direct crossing provided:
A. 
The crossing is made at an angle of approximately 90° to the direction of the street, road, or highway and at a place where no obstruction prevents a quick and safe crossing; and
B. 
The golf cart is brought to a complete stop before attempting a crossing; and
C. 
The operator of the golf cart yields the right-of-way to all pedestrians and vehicular traffic which constitutes a hazard; and

D. 
When crossing a divided highway, the cross is made only at an intersection of the highway with another public street, road, or highway.
No action by the Village of Morrisonville under this article or 625 ILCS 5/11-1426.1 designates the operation of a golf cart as an intended or permitted use of property with respect to Section 3-102 of the Local Governmental and Governmental Employees Tort Immunity Act (745 ILCS 10/3-102).
A person may not operate a golf cart as otherwise set forth in this article upon the street and roadways as otherwise set forth herein unless he/she has a valid Illinois driver's license issued in his/her name by the Illinois Secretary of State, or a valid out of state driver's license issued in his/her name by the appropriate department/agency of that state responsible for issuing driver's licenses.
Any person who violates any terms or provisions of this article shall be subject to a fine, upon conviction, in an amount not less than $75 nor more than $750 for each separate offense.
