This article shall be known and may be cited as the "Incorporated Village of Sands Point Vehicle and Traffic Ordinance."
As used in this article, unless otherwise expressly stated or unless the context or subject matter otherwise requires, the following terms shall respectively be deemed to mean and include the following:
Junked Vehicles
Any Motor Vehicle, including a Trailer, which is not duly registered, as required, pursuant to Vehicle and Traffic Law § 401 or is in a rusted, wrecked, discarded, dismantled, partly dismantled, inoperative, or abandoned condition.
Motor Vehicle
All Vehicles propelled by any power other than muscular power except tractors, engines, road rollers, tractor cranes, truck cranes, power shovels, road-building machines, snowplows, road sweepers, sand spreaders, and Village-owned electric carts.
One-Way Street
Any Thoroughfare whereon traffic is restricted in one direction.
Overnight
Between the hours of midnight and 6:00 a.m.
Parking
Leaving a Motor Vehicle unoccupied by a person having physical control over it, standing motionless, and unattended for an interval of time longer than necessary to board or unload passengers or items.
Parking Space
That part of any Thoroughfare, parking field, area, or space designated by a sign, signs, or other markings as a place for the parking of Motor Vehicles.
Person
Any natural person, corporation, entity, company, association, joint-stock association, firm, or copartnership.
Residential Property
Those premises located within the geographical boundaries of Residence A Districts, Residence B, and Residence C Districts as shown on the Building Zone Map of the Village of Sands Point.
Stand, Standing, or Left Standing
The cessation of movement upon any Thoroughfare of a Motor Vehicle for the purposes of loading or unloading people or items except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer and/or Traffic Signs and Signals.
Stop, Stopped, or Stopping
The cessation of movement of a Motor Vehicle upon any Thoroughfare except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer and/or Traffic Signs and Signals.
Thoroughfare
For the purposes of this Chapter only, any highway, public road, private street, public street, private road, private street, avenue, lane, alley, public place, public driveway, or other public or private way.
Traffic Signs and Signals
All signs, markings, devices, and signals for the purpose of guiding, directing, warning, or regulating traffic or parking which are located upon Streets Thoroughfares pursuant to this article.
Trailer
Any device not propelled by its own power drawn on the public highways by a Motor Vehicle.
Village
The Incorporated Village of Sands Point.
Village Board
The Board of Trustees of the Village.
Wide Load Vehicle
Motor Vehicles and/or their Trailers which exceed the legal dimensions or weights specified in § 385 of the New York State Vehicle and Traffic Law and which require Special Hauling permits to operate on New York State highways.

A. 
Except as otherwise provided in this section, no Person shall operate a Motor Vehicle upon any Thoroughfare within the corporate limits of the Village at a rate of speed in excess of 30 miles per hour. This section shall not apply to ambulances, fire vehicles, or police vehicles, public works vehicles, or vehicles of the Village when on emergency trips or when conducting official Village business or patrol activities.
B. 
No Person shall operate a Motor Vehicle on Astor Lane at a rate of speed in excess of 25 miles per hour. This section shall not apply to ambulances, fire vehicles, or police vehicles, public works vehicles, or vehicles of the Village when on emergency trips or when conducting official Village business or patrol activities.
A. 
Wide Load Vehicles shall not be operated upon Thoroughfares of the Village, except between the hours of 10:00 p.m. and 1:00 a.m., and between the hours of 5:00 a.m. and 7:00 a.m., Monday through Friday, and only upon no less than 72 hours' prior notification of the Village of Sands Point Police Department, and upon the Police Department's approval. An application shall be submitted to the Village, the fee for which shall be $500.
B. 
The Wide Load Vehicle operator may request permission to operate the Wide Load Vehicle at other times, but only upon a showing of the necessity why such operation cannot occur during the restricted hours. The determination of the request shall be at the discretion of the Sands Point Police Department.
C. 
The Wide Load Vehicle operator may request a waiver of the 72 hours' prior notification requirement upon a showing of the necessity of the request. The Wide Load Vehicle operator shall pay an additional fee of $500 for the request. The determination of the request shall be at the discretion of the Sands Point Police Department.
D. 
The operator of the Wide Load Vehicle shall be responsible for any overtime cost to the Sands Point Police Department that will be necessary for the escort of the Wide Load Vehicle within the Village.
E. 
Any damage or anticipated damage to Thoroughfares within the Village as a result of the operation of a Wide Load Vehicle shall be paid in advance or in arrears, as the decision of the Village, compensated by the owner or operator of such Wide Load Vehicle.
F. 
No Person shall operate or permit to be operated, cause, or knowingly permit or be permitted or move on any Thoroughfare, any Motor Vehicle in violation of Federal Motor Carrier Safety Regulations Parts 393 through 397, inclusive.
A. 
The following Streets of the Village are hereby designated as One-Way Streets: Lighthouse Road.
B. 
No Person shall operate a Motor Vehicle on any One-Way Thoroughfare except in the direction indicated by posted signs.
A. 
No Motor Vehicle shall Park, Stop, or Stand on any Thoroughfare in the Village except as hereinafter provided in this section.
B. 
The Village Board may, by resolution or order of the Mayor, designate Thoroughfares or parts of Thoroughfares where Parking, Stopping, or Standing of Motor Vehicles shall or shall not be permitted and fix the time thereof.
C. 
No person shall Park, Stop, or Stand a Vehicle or Motor Vehicles on any Thoroughfare or in any zone so designated by resolution of the Village Board for a period in excess of that which had been fixed by resolution of the Village Board of Trustees or as displayed on any Traffic Signs or Signals.
No Person shall fail, neglect, or refuse to comply with any reasonable order of a police officer engaged in the direction of traffic nor with any lawful traffic regulations displayed on Traffic Signs and Signals.
No Motor Vehicle shall be operated or driven off the improved or paved portion of a Thoroughfare, except where parking or driving shall be permitted.
No disabled Motor Vehicle shall be permitted to remain on a Thoroughfare for a longer period than required to remove the same. In no event shall said period exceed one hour.
No Person shall cause or permit a Motor Vehicle to be operated on any Thoroughfare, zone, or on Parking Spaces or to be Stopped or parked so as to necessarily obstruct traffic.
A. 
The system of pavement markings duly adopted for state highways is hereby adopted for all Thoroughfares in the Village.
B. 
Each of the Village Board of Trustees and Mayor shall have the power to order the erection and maintenance of such Traffic Signs and Signals or markings as it may deem necessary for the enforcement of this article.
A. 
The parking of any Motor Vehicle on residential property other than on a driveway or in a garage is prohibited, unless permission is granted by the Village or police department.
B. 
The Overnight Parking of any Motor Vehicle or exhibiting commercial logos or trademarks or of any Trailer on residential property is prohibited unless said vehicle is garaged.
C. 
The Overnight Parking of any Motor Vehicle other than passenger automobiles or any Motor Vehicle greater than eight feet in height or with more than four wheels is prohibited.
The parking of Junked Vehicles, other than in an enclosed garage or in a location from which it cannot be seen from a Thoroughfare or from a neighboring property, is prohibited.
Anything herein to the contrary notwithstanding, exemptions to § 163-12 may be granted upon demonstration that the exemption sought is not injurious to the public health and welfare, by issuance, for a period of not to exceed 30 days, of a certificate of exemption, by application of the property owner to the Village. No such certificate shall be granted or renewed more than three times in each calendar year.
A. 
Any Person violating any of the provisions of § 163-3 of this chapter shall, upon conviction, be punished by a fine, guided by and utilizing the penalty schedules contained in the New York State Vehicle and Traffic Law where applicable, not to exceed $1,000.
B. 
The violation of any of the provisions of this chapter, except §§ 163-3, 163-4 and 163-12 by any Person violating the same shall, upon conviction, pay a penalty, guided by and utilizing the penalty schedules of the New York State Vehicle and Traffic Law where applicable, not to exceed $500 for each and every offense.
C. 
Any Person, which shall include the operator of a Wide Load Vehicle, or the property owner who arranged for delivery by a Wide Load Vehicle without coordinating with the Village of Sands Point Police Department, violating any provision of § 163-4A through F of this chapter shall, upon conviction be punished by and utilizing the penalty schedules contained in the New York State Vehicle and Traffic Law where applicable, not to exceed $10,000 per event, which shall be defined as each Wide Load Vehicle brought into the Village.
D. 
Any person violating the provisions of § 163-12 shall pay a penalty of not less than $100 nor more than $500 for each offense. It shall be deemed a new or additional offense for every twenty-four-hour period during which the condition continues unabated, provided that a new accusatory instrument is issued.
