A. 
It shall be unlawful for any person within the Village to rent or license, or offer to rent or license, any living accommodations as a short-term rental for monetary compensation or other valuable consideration, unless the living accommodations constituting the short-term rental are permitted under a special permit issued by the Board of Trustees pursuant to the provisions and standards set forth in Article XIII of the Zoning Code.
B. 
A special permit to permit a short-term rental shall be required in all single-family, two-family, and multiple-family residential dwellings within the Village.
C. 
The special permit requirement on short-term rentals shall not apply to a commercial hotel/motel business or bed-and-breakfast establishment operating exclusively as such and which is lawfully licensed or permitted for such use pursuant to the Village Zoning Code and regulated by applicable state, county and local law or ordinance.
D. 
Any provision of a lease or rental agreement purporting to waive any provision of this section is unlawful.
E. 
Nothing in this section shall be construed as invalidating or impairing the operation of, or the right of a landlord to restrict occupancy in order to comply with, federal, state or local laws, regulations, ordinances, or codes.
F. 
A person or entity (including a principal of any entity) who rents property from a premises owner or lawful lessee who is in violation of this section shall be deemed to be an accessory to the offense provided herein.
G. 
Any person who shall violate any provision of this section shall first receive a warning of said violation from the Building Inspector. Each violation issued thereafter shall be subject to the penalties set forth in §§ 117-15 and 117-16, Article IV of this chapter, titled "Penalties."
H. 
In addition to the penalties contained herein, it shall be the right of the Village to seek injunctive relief in any civil court having jurisdiction over this matter to prevent any violation or violations of this section.
The forms to obtain a special permit for a short-term rental shall be made available by the Building Department, who shall process any application made to permit a short-term rental in the manner a special permit application is processed by that Department. The fee to obtain a short-term rental special permit shall be set forth in the Building Department schedule of fees, which may be amended from time to time by resolution of the Board of Trustees.

The Building Inspector or his/her authorized agent shall make provisions for the biennial inspection of each short-term rental premises which is subject to the provisions of this article and shall notify each owner/landlord of each rental premises as to the time and place of such inspection. The inspection shall be for the purposes of determining compliance with Chapter 154 of the Village Code and other applicable laws, and shall expressly include in each instance the determination of the presence of functioning and proper placement of smoke and carbon monoxide detectors as well as fire extinguishers pursuant to the provisions of state law and this Code.
B. 
Any inspection report issued pursuant to Subsection A of this section which reveals the presence of a violation of this article of the Village Code shall be remedied by the owner within 10 days of the issuance of such report. Failure to bring any dwelling into conformance with such report within 10 days of the issuance of such report shall constitute a violation of this article.
This Article III of Chapter 117 of the Code of the Village of Piermont is adopted pursuant to the New York State Constitution and § 10 of the Municipal Home Rule Law.
