As used in this article, the following terms shall have the meanings indicated:
CARTWAY
The portion of a street right-of-way normally paved or stoned and designed or intended for vehicular use.
PERSON
Any corporation, partnership, association, receiver, legal representative, trustee, trustee in bankruptcy, labor organization, municipality, or individual, as well as any other entity recognized as a "person" at law.
RIGHT-OF-WAY
Land usually linear in configuration, set aside for use as streets, roads, pedestrian ways or other means of travel and/or for the location of public utilities.
SIDEWALK
Portion of a street between the curblines, or the lateral lines of a cartway, and the adjacent property lines, intended for use by pedestrians; and also included within the definition is an area of two feet surrounding any fire hydrant.
YARD WASTE
Includes grass, grass clippings, leaves, branches, brush, bushes, shrubs, and clippings from bushes and shrubs that come from residential, commercial/retail, institutional, or industrial sources as part of maintaining yards or other private or public lands.
Except as otherwise approved by the Township, no person shall stockpile, deposit, or cause to be stockpiled or deposited, yard waste within the right-of-way of public streets, such that the deposit of yard waste is located upon the cartway, shoulder, sidewalk, or any other portion of the public right-of-way that creates a hazard to motorists, bicyclists, or pedestrians; or which obstructs roadside drainage facilities (including, but not limited to, drainage swales, storm sewer inlets, culverts, and driveway pipes) or public utilities.
Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine not more than $600, and costs, and in default of payment, to imprisonment for a term not to exceed 30 days. Each day that a violation continues shall constitute a separate offense.
All articles or parts of articles which are inconsistent herewith are hereby repealed.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this article. It is hereby declared as the intent of Hilltown Township that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
This article shall be effective five days after enactment.
