For the purpose of carrying out the powers granted in this charter,
the council may pass all necessary ordinances. All the powers of the
town shall be exercised in the manner prescribed by this charter,
or if the manner be not prescribed, then in such manner as may be
prescribed by ordinance.
To ensure the observance of the ordinances of the town, the
council has the power to provide that violation thereof shall be a
misdemeanor, unless otherwise declared to be a municipal infraction,
and has the power to affix thereto penalties of a fine not exceeding
$1,000 or imprisonment not exceeding six months, or both such fine
and imprisonment. Any person subject to any penalty has the right
of appeal within ten days to the circuit court of the county in which
the penalty was imposed. The council may provide that, if the violation
is of a continuing nature and is persisted in, a conviction for one
violation shall not be a bar to a conviction for a continuation of
the offense subsequent to the first or any succeeding conviction.
