A. The City of St. Francis, Milwaukee County, Wisconsin,
hereby adopts traffic regulations in strict conformity with state
law by incorporating and enacting traffic regulations set forth in
Chs. 341 to 348 and 350, Wis. Stats., for which the penalty for violation
thereof is a forfeiture, excepting traffic regulations relating to
the suspension or revocation of motor vehicle operator licenses.
B. The City of St. Francis further incorporates and enacts
parking regulations and penalties for violation of those regulations
which are in conformity with the provisions of §§ 346.503,
346.505 and 346.56, Wis. Stats.
C. The City of St. Francis further incorporates and enacts
traffic regulations that are in strict conformity with any rule of
the Department of Transportation promulgated under Ch. 100, 347 or
346, Wis. Stats., except rules pertaining to federal motor carrier
safety standards, for which the penalty for a violation thereof is
a forfeiture.
A. One-hour parking. No person shall park or leave running
any vehicle for more than one hour on the following streets:
(1) The west side of South Kinnickinnic Avenue from the
north City limits to a point 250 feet north of East St. Francis Avenue,
between 7:00 a.m. and 7:00 p.m., except on Saturday and Sunday.
B. One-and-one-half-hour parking. No person shall park
or leave running any vehicle for more than 1 1/2 hours on the
following streets:
(1) South Kinnickinnic Avenue.
(a)
West side from a point 250 feet north of the
center line of East St. Francis Avenue continuing north to a point
350.3 feet north of such center line, and again from a point 389.5
feet north of the center line of East St. Francis Avenue continuing
north to a point 560 feet north of such center line.
(b)
East side from a point 250 feet north of the
center line of East St. Francis Avenue continuing north to a point
550 feet north of such center line.
C. Two-hour parking. No person shall park or leave running
any vehicle for more than two hours on the following streets:
(1) The south side of East Norwich Avenue between South
Iowa Avenue and South Kansas Avenue, between 6:00 a.m. and 6:00 p.m.,
except on Saturday and Sunday.
(2) The north side of East Norwich Avenue between South
Iowa Avenue and the nearest west line of the Chicago and Northwestern
Railway Company right-of-way, between 6:00 a.m. and 7:00 p.m., except
Saturday and Sunday.
(3) The south side of East Tesch Avenue from the east
lot line of 1829 East Tesch Avenue west to the end of East Tesch Avenue,
between 6:00 a.m. and 6:00 p.m., except Saturday and Sunday.
(4) The north side of East Norwich Avenue between South
Kansas Avenue and South Iowa Avenue, between 6:00 a.m. and 6:00 p.m.,
except Saturday and Sunday.
(5) The south side of East Waterford Avenue from 2941
Waterford west to Kinnickinnic and Waterford, between 8:00 a.m. and
6:00 p.m.
(6) The east side of South Iowa Avenue between East Norwich
Avenue and East Howard Avenue, between 9:00 a.m. and 3:00 p.m., except
Saturday and Sunday.
(7) East Tesch Avenue, south side, from South Packard
Avenue to a point 151.3 feet west of the center line of South Packard
Avenue, from 8:00 a.m. to 5:00 p.m.
(8) East Tesch Avenue, south side, from a point 337 feet
west of the center line of South Iowa Avenue continuing westerly to
the westernmost termination of the street, 6:00 a.m. to 6:00 p.m.,
except Saturday and Sunday.
(9) On
the south side of East Sivyer Avenue from the west right-of-way line
of South Packard Avenue to approximately 100 feet west of the west
right-of-way line of South Packard Avenue.

D. Three-hour parking. No person shall park or leave
running any vehicle for more than three hours on the following streets:
(1) The south side of East Norwich Avenue from Kinnickinnic
and Norwich, east of 2945 East Norwich Avenue, between 7:00 a.m. and
7:00 p.m., except Saturday and Sunday.
E. Parking during certain hours. No person shall park
or leave running any vehicle during the hours as designated on certain
portions of the following streets:
(1) East Bolivar Avenue.
(a)
During school days (7:30 a.m. to 4:30 p.m.)
on the north side from 49 feet west of the center line of Delaware
Avenue to a point 215 feet west of the center line of Delaware Avenue.
(b)
North side, no stopping between signs, from
46 feet east of Delaware Avenue to 49 feet west of Delaware Avenue.
(2) East Tesch Avenue. North side from 6:00 a.m. to 6:00
p.m., except Saturday and Sunday, from Tesch and Iowa west to the
end of Tesch.
(3) South Iowa Avenue. Per Ordinance No. 1149 passed February
3, 2004.
(4) South Kingan Avenue. On the east side between East
Lunham and East Denton, from 5:00 p.m. to 8:00 p.m. This shall be
in effect from April 15 through August 31.
(5) South Lake Drive.

(7) South Kinnickinnic Avenue. West side, commencing at
the center line of East Klein Drive and continuing south to a point
306 feet south of the center line of East Klein Drive, 7:30 a.m. and
8:30 a.m. to 2:30 p.m., 3:30 p.m., Monday through Friday.
(8) East Crawford Avenue.

North side, from 62 feet west of the center
line of South Kinnickinnic Avenue to 108 feet west of the same center
line, 7:00 a.m. to 4:00 p.m., except Saturday, Sunday and holidays.
(b)
South side, from 83 feet west of the center
line of South Kinnickinnic Avenue to 121 feet west of the same center
line, 7:00 a.m. to 4:00 p.m., except Saturday, Sunday and holidays.
(9) East Sivyer Avenue. North side, near the intersection
of North Sivyer Avenue and South Packard Avenue from 7:00 a.m. to
2:00 p.m., Monday through Friday, from a point currently designated
as the fourth perpendicular parking space to the 11th perpendicular
parking space.

F. Overnight parking.
(1) Regulated. No person shall park any vehicle on any street within the City between the hours of 3:00 a.m. and 5:00 a.m., except Saturday and Sunday, unless said vehicle is displaying a valid permit issued under this §
435-2F in the manner directed by the Police Department.

(2) Fees.
(a)
Permits shall be issued for special periods
upon payment of the fees as provided by the current fee schedule on
file with the City Clerk.
(b)
Exception. The Police Department may permit
overnight parking not to exceed three nights per calendar month without
permit and fee.
(3) Other parking regulations. Such permits are subject
to all other City traffic laws, including emergency situations.
(4) Alternate parking. Vehicles shall park only on the even-numbered side of the street on nights bearing an even calendar date before 12:00 midnight and on the odd-numbered side of the street on nights bearing an odd calendar date before 12:00 midnight. Alternate parking shall not be enforced on those streets where other parking restrictions or other matters prevent such alternate parking. Alternate parking restrictions shall also not be enforced in any area of a City street that has been designated as "Handicap parking only" under §
435-2I of this Code.

(5) Reciprocity. Where South Brust Avenue, Clement Avenue,
Hanson Avenue, Kansas Avenue and Nevada Avenue and East Norwich Street
lie on the boundary between the City of Milwaukee and the City of
St. Francis, all-night parking permits issued by the City of Milwaukee
shall become valid in the City of St. Francis to the same extent as
if such permit had been issued by the City of St. Francis; provided,
however, that the provisions of this subsection shall be effective
only during such time as the City of Milwaukee authorizes, by ordinance,
a reciprocal privilege on such streets for all-night parking permits
issued by the City of St. Francis. Further, the parking restrictions
for all-night parking shall be enforced in the same manner as provided
above.
(6) Vehicle defined. For purposes of this Subsection
F, "vehicle" shall include but not be limited to autos, vans, minivans, trucks, boats, trailers, snowmobiles, jet skis, recreational vehicles or any apparatus that has the capability of self-movement, towing or pushing. "Trailers" shall be as defined by the Wisconsin Statutes, as they are amended from time to time, and shall be attached to a tow vehicle, including the tongue of trailer on ball of tow vehicle chains and electrical connections attached. Trailers shall be properly licensed and lighted as set forth in the Wisconsin Statutes.
G. No stopping, standing or parking under certain conditions. No person
shall park, stop or leave standing any vehicle, whether attended or
unattended, on any street or in any area:

(1) When
such street or area is posted with temporary "No Parking" or "No Stopping,
Standing or Parking" signs. The Mayor, City Engineer and Chief of
Police shall have the power and authority to cause such signs to be
erected.
(2) When
a police officer so orders in an appropriate situation.
(3) On South
Kinnickinnic Avenue:
(a) East
side, from a point 142 feet north of the center line of East Elizabeth
Avenue continuing north to a point 250 feet north of the center line
of East St. Francis Avenue.
(b) East
side, from a point 323 feet south of the center line of East Norwich
Avenue and continuing northerly to a point 295 feet north of the center
line of East Norwich Avenue.
(c) From
the intersection with Denton Avenue and continuing south to a point
approximately 350 feet south of the intersection of the center lines
of South Kinnickinnic Avenue and Denton Avenue.
(d) West
side, from a point 295 feet north of the center line of East Norwich
Avenue and continuing southerly to a point 300 feet south of the center
line of East Norwich Avenue.
(e) West
side, from a point 250 feet north of the center line of East St. Francis
continuing southerly to a point 315 feet south of the center line
of East St. Francis Avenue.
(4) On both
sides of South Brook Place, commencing at a point 192 feet north of
the center line of East Crawford Avenue and continuing northerly and
following the curve in the road onto East Elizabeth Avenue to a point
327 feet from the center line of East Crawford Avenue.
(5) On East
Howard Avenue, south side, from 124 feet west of South Arctic Avenue
easterly to the center line of South Arctic Avenue.
H. Overnight parking of certain vehicles in residential
areas prohibited.

(1) Except as provided in Subsection
H(3) below, no person shall park any vehicle described in Subsection
H(1)(a) through
(e) below on any City street, alley, terrace way or other area reserved for public use during hours of darkness; and no person having ownership or control of a vehicle of such type(s) shall allow or cause such vehicle to remain so parked during hours of darkness:
(a)
Any vehicle licensed as having a gross vehicle weight of over
8,000 pounds that is designed, intended, or used for agricultural,
commercial, or construction purposes.
(b)
Any vehicle having more than six wheels.
(c)
Any vehicle exceeding 20 feet in length.
(d)
Any semi-tractor, semi-trailer, or semi-tractor/trailer combination.
(e)
Any trailer, irrespective of whether such trailer is attached
to a vehicle that is otherwise permitted.
(2) "Residential area" is defined for purposes of this Subsection
H as any area within the City of St. Francis that is zoned for residential use and any block within the City wherein more than 50% of the land use on either side of the street is used for residential purposes.
(3) These provisions shall not apply to:
(a)
Any motor vehicle licensed as an automobile or as a sports-utility
vehicle;
(b)
Any pickup truck licensed as having a gross motor vehicle weight
of 8,000 pounds or less; or
(c)
Any vehicle that is being used for active loading or unloading
for a period of 20 minutes or less.
(4) No overnight parking permit issued under §
435-2F shall be deemed to modify or limit the provisions of this section.
I. Parking spaces for vehicles displaying special registration plates
or special identification cards. The following locations on City streets
shall be designated under § 346.503, Wis. Stats., as parking
spaces for vehicles displaying special registration plates or special
identification cards, and the provisions of the Wisconsin Statutes
regarding parking for motor vehicles used by physically disabled persons
shall be enforced:

(28) East Waterford Avenue. North side, from the easterly

(29) South Whitnall Avenue. Both sides, between South Clement
Avenue (westerly City limits) and westerly line of Chicago and Northwestern
Railway right-of-way track overpass.
(30) South
Rutland Avenue. East side, between East Bolivar Avenue and East Leroy

B. Where any street is improved by sidewalk, curb and
gutter, there shall be no parking between such sidewalk and curb and
gutter, except in the area where the curb opening would be projected
from the curb to the sidewalk (i.e., the improved approach area in
concrete). Such parking shall not encroach on or over any sidewalk,
curb, gutter or street pavement.
The following portions of streets are designated
as loading zones and parking shall be permitted only for loading or
unloading vehicles:
A. South Lake Drive. East side, from main gate north
to "Signals Ahead" sign.
B. East St. Francis Avenue. South side, from a point
26 feet west of the intersection of St. Francis Avenue and South Ellen
Street to a point 63 feet west of the same intersection.

A. No person shall park or leave running any vehicle
in the parking lots on the north and west sides of the Municipal Building
at 4235 South Nicholson Avenue, except authorized parking only. "Authorized
parking" includes only parking of vehicles:
(1) By employees during working hours.
(2) By persons visiting, attending meetings, or having
to do business with the City, during the period of such activity.
(3) By or under City police direction, or in the following
spaces:
(a)
Space marked "Reserved Parking" (with "handicapped"
symbol).
(b)
Spaces marked "Authorized Personnel Only" between
7:00 a.m. and 5:00 p.m.
(c)
North side, one space reserved for handicapped
only, as placed by the City Engineer.
(d)
West side of lot at alley, first and second
spaces north of cellular telephone building shall be for police vehicles
only.
B. No person shall park or leave running any vehicle
in the parking lot of the St. Francis Public Library, 4230 South Nicholson
Avenue, except within 1/2 hour of opening and closing of the library,
or under permission of the Library Director.
The Common Council may, by majority vote, allow
parking in an otherwise restricted area. Such may only be allowed
as follows:
A. Such restriction must exist by previous action of
the City.
B. Such relief may not be for more than 48 hours.
C. Such relief may be given only for nonprofit functions
or nonprofit organizations.
D. No more than three such waivers may be granted for
any area in a twelve-month period.
E. Such relief is discretionary and any request may be
denied as the Council may see fit.
Whenever any police officer finds a vehicle
illegally stopped, standing or parked, he may cause the same to be
removed by the City by an appropriate towing company, at the officer's
discretion, and be kept there until the owner presents to the towing
company a release from the Police Department authorizing the towing
company to turn over the vehicle to him. Prior to issuance of such
release, the Police Department shall receive from the violator the
cost of towing and storage and may issue a citation for violation
of this chapter.
A. With the exception of Subsection
B below, §§ 346.57, 346.58 and 346.59, Wis. Stats., relating to minimum and maximum speed of vehicles, are adopted by reference and incorporated herein as though set forth in full.
B. Exceptions. The limits set forth above are modified
under the authority granted by § 349.11, Wis. Stats., as
follows:
(1) Thirty miles per hour.
(a)
South Clement Avenue from the south City limits
to the north City limits.
(b)
South Kinnickinnic Avenue between the north
City limits and the south City limits.
(c)
South Lake Drive between the north City limits
and the south City limits.
(d)
East Layton Avenue from the east City limits
to the west edge of the overhead bridge over the Chicago and Northwestern
Railway tracks.
(e)
South Packard Avenue between South Lake Drive
and the south City limits.
(f)
South Pennsylvania Avenue between Elizabeth

(2) Thirty-five miles per hour. East Layton Avenue from
the west edge of the overhead bridge over the Chicago and Northwestern
Railway tracks to the west City limits.

That portion of the overhead bridge over the
Chicago and Northwestern Railway tracks on East Leroy Avenue.
(b)
That portion of the overhead bridge over the
Chicago and Northwestern Railway tracks on East Norwich Avenue.
(4) Twenty miles per hour. South Kinnickinnic Avenue, between East St. Francis Avenue and a point 160 feet south of the center line of East Crawford Avenue, notwithstanding the speed limit provisions in Subsection
B(1)(b) above.
(5) Fifteen miles per hour. That portion along the curve
of East Leroy and Kansas Avenues measured as follows: from the center
line of South Iowa Avenue along the northern side of East Leroy Avenue
and the east side of South Kansas Avenue, commencing at a point 515
feet west of such center line and continuing generally westerly and
northerly along such curve another 170 feet; further, from the center
line of East Norwich along the western side of South Kansas Avenue
and the south side of East Leroy Avenue, commencing at a point 1,245
feet south of such center line and continuing generally southerly
and easterly along such curve another 1,447 feet.
Pursuant to § 349.07, Wis. Stats., the following streets or portions thereof are declared to be through highways, and traffic signs and signals thereon shall be erected by the City Engineer in accordance with §
435-24 of this chapter:
A. South Clement Avenue from the north curbline of South
Whitnall Avenue to the northerly City limits.
B. East Howard Avenue between the west City limits and
east curbline of South Iowa Avenue and between the west curbline of
South Lipton Avenue and west curbline of South Lake Drive.
C. South Iowa Avenue between the south curbline of East

A. Defined. "Heavy traffic" shall have the meaning as given by § 349.17(2),
Wis. Stats., as it may be amended from time to time.
B. Routes where permitted. Heavy traffic shall be permitted only on
the following streets. Heavy traffic on any other street shall be
in violation of this section, except as provided, however, pursuant
to in § 349.17(1), Wis. Stats., as it may be amended from
time to time. This section shall not be deemed to prohibit heavy traffic
from using a street or highway for the purpose of obtaining orders
for supplies or moving or delivering supplies or commodities to or
from any place of business or residence which has an entrance on such
street or highway.

A. All streets

by § 348.16, Wis. Stats.

32, East Howard Avenue between South Lake Drive and South Kinnickinnic
Avenue.

32, South Kinnickinnic Avenue between the north and south City limits.
B. Special
and seasonal weight limitations. The City Engineer shall impose special
weight limits to prevent injury to the roadway or any highway, bridge
or culvert within the jurisdiction of the City, for the safety of
users of the same, and shall be responsible for erecting signs giving
notice thereof in accordance with § 349.16, Wis. Stats.
A. Defined. A snow emergency exists when three inches
or more of snow fall in the City within 24 hours. A snow emergency
may also be called by the Mayor or, in his absence, the President
of the Common Council, when weather forecasts predict an accumulation
of three inches or more within 24 hours. Such an emergency exists
until snowplowing operations are completed, as declared by the Mayor
or, in his absence, the President of the Common Council.
B. Public announcement. Whenever such an emergency exists
or is declared, the Mayor or, in his absence, the President of the
Common Council shall cause announcement of the emergency to be broadcast
by at least two radio stations whose operating range covers the City.
C. Parking.

(1) Prohibited. During snow emergencies, no person shall park any vehicle
on any street upon which there is operated public transportation for
longer than three minutes to unload or load passengers or 30 minutes

(2) Alternate parking. During snow emergencies, vehicles shall be parked
only on the even-numbered side of the street on nights bearing an
even calendar date before 12:00 midnight and on the odd-numbered side
of the street on nights bearing an odd calendar date before 12:00
midnight.
(3) Removal. No person shall cause or allow any vehicle to remain parked
or standing contrary to the provisions of this subsection after 9:00
a.m. following the declaration of an emergency. The Highway Superintendent
shall cause any vehicle which interferes with or prevents snowplowing
and removal to be removed from the street and the cost of such vehicle
removal shall be paid by the owner.
No directing officer or operator of a railway
shall direct or operate a train so as to prevent the use of any street
for travel for longer than five minutes, except when the train or
cars are in motion other than those engaged in switching.
A. Defined. "Motorized device" shall mean any self-propelled
device which is driven by internal combustion engine or electric motor
and includes but is not limited to such devices commonly known as
"minibikes," "go carts," "snowmobiles" and "garden tractors."
B. Registration. No person shall operate any such device
on any public property unless it is registered as prescribed in Ch.
341, Wis. Stats., or its operation is specifically permitted by statute.
C. Permission to operate on private property. No person
shall operate such a device on any private property without the permission
of the owner of the property. In the property owner's absence, the
operator of the device shall have in his possession written proof
of such permission.
D. Permission to operate on City property. No person
shall operate such a device on any City property without a permit
approved by the Common Council or its designated agent.
E. Operation by minors. No parent or guardian of any
child under the age of 18 years shall authorize or knowingly permit
such child to violate any of the provisions of this section.
Any person who operates an all-terrain vehicle,
or any other type of motorized device, off the public roads shall
operate in such a manner so as not to disturb any business, residence
or person. Further, no mud, dirt, vegetation or other material shall
be deposited on any public road from the operation of such vehicles.
No person shall permit any motor vehicle in
his custody to stand or remain unattended on any street or alley or
other public area, except an attended parking area, unless either
the starting lever, throttle, steering apparatus, gear shift or ignition
of the vehicle is locked and the key for such is removed from the
vehicle.
A. Established. All persons shall comply with the laws
at the following crosswalks in the same manner as crosswalks at intersections:
(1) Two crosswalks on South Kinnickinnic Avenue at the
entrances to Sacred Heart Church, located at approximately 3635 South
Kinnickinnic Avenue.
(2) Two crosswalks on South Nevada Avenue just north of
East Bolivar Avenue, between industrial buildings as determined by
the City Engineer.
B. Removed. The following crosswalks shall be removed
and pedestrian crossing prohibited:
(1) At the western intersection of South Ellen Street
with St. Francis Avenue (being an "offset T" intersection) at the
eastern crosswalk.
(2) On South Kinnickinnic Avenue at East Elizabeth Avenue,
both the northern and southern crosswalks.

A. Created. A school crossing is hereby created to permit
the safe crossing of pedestrians, particularly school children, over
South Kinnickinnic Avenue at East Denton Avenue.
B. Speed limit near school crossing. In the further interest of public safety, a school zone requiring the reduction of traffic speed to 20 miles per hour is hereby created to extend 194 feet north and 194 feet south of the school crossing described in Subsection
A. The change in speed limit and the school crossing shall be identified to traffic by posting of the signage described in Subsection
D.
C. Penalties for violation of the speed limit near school
crossing. Violation of the posted speed limit in and around the school
crossing shall be punishable as follows:
(1) First offense punishable by citation of $500;
(2) Second offense punishable by citation of $750; and
(3) Third offense punishable by citation of $1,000.
D. Posting. The City Engineer is hereby directed to post
the following signage in the locations described:
(1) On South Kinnickinnic Avenue for the benefit of traffic
traveling northbound on South Kinnickinnic Avenue:
(a)
Signage placed immediately south of the school crossing created in Subsection
A indicating the presence of such school crossing and crosswalk;
(b)
One hundred ninety-four feet south of the signage described in Subsection
D(1)(a), signage indicating the commencement of the school zone and limiting speed to 20 miles per hour when children are present; and
(c)
Two hundred fifty-two feet south of the signage described in Subsection
D(1)(b), signage indicating a school crossing is ahead.
(2) On South Kinnickinnic Avenue for the benefit of traffic
traveling southbound on South Kinnickinnic Avenue:
(a)
Signage placed immediately north of the school crossing created in Subsection
A indicating the presence of such school crossing and crosswalk;
(b)
One hundred ninety-four feet north of the signage described in Subsection
D(2)(a), signage indicating the commencement of the school zone and limiting speed to 20 miles per hour when children are present; and
(c)
One hundred thirty-two feet north of the signage described in Subsection
D(2)(b), signage indicating a school crossing is ahead.
E. Marking. The City Engineer shall mark the roadway, as necessary, to define the school crossing created by Subsection
A.

A. School zones and school crossings are hereby created as follows:
(1)
South Pennsylvania Avenue.
(a)
On South Pennsylvania Avenue for the benefit of traffic traveling
northbound on South Pennsylvania Avenue:
[1] One hundred feet south of the south right-of-way
of East Bolivar Avenue east of South Pennsylvania Avenue, signage
indicating the commencement of the school zone and limiting speed
to 20 miles per hour when children are present; and
[2] Two hundred feet south of the south right-of-way
of East Bolivar Avenue east of South Pennsylvania Avenue, signage
indicating a school crossing is ahead.
(b)
On South Pennsylvania Avenue for the benefit of traffic traveling
southbound on South Pennsylvania Avenue:
[1] One hundred feet north of the north right-of-way
of East Bolivar Avenue east of South Pennsylvania Avenue, signage
indicating the commencement of the school zone and limiting speed
to 20 miles per hour when children are present; and
[2] Two hundred feet north of the north right-of-way
of East Bolivar Avenue east of South Pennsylvania Avenue, signage
indicating a school crossing is ahead.
(2)
East Bolivar Avenue.
(a)
On East Bolivar Avenue for the benefit of traffic traveling
eastbound on East Bolivar Avenue:
[1] Five hundred feet west of the west right-of-way
of South Delaware Avenue, signage indicating the commencement of the
school zone and limiting speed to 20 miles per hour when children
are present; and
(b)
On East Bolivar Avenue for the benefit of traffic traveling
westbound on East Bolivar Avenue:
[1] Twenty feet west of the west right-of-way of East
Vermont Court, signage indicating the commencement of the school zone
and limiting speed to 20 miles per hour when children are present;
and
[2] One hundred feet east of the east right-of-way
of East Vermont Court, signage indicating a school crossing is ahead.
(3)
South Delaware Avenue. On South Delaware Avenue for the benefit
of traffic traveling northbound on South Delaware Avenue:
(a)
One hundred feet south of the south right-of-way of East Bolivar
Avenue, signage indicating the commencement of the school zone and
limiting speed to 20 miles per hour when children are present; and
(b)
One hundred feet south of the south right-of-way of East Bolivar
Avenue, signage indicating a school crossing is ahead.
B. These zones are created to permit the safe crossing of pedestrians,
particularly school children, on South Pennsylvania Avenue, East Bolivar
Avenue and South Delaware Avenue and in support of the Willow Glen
Primary School area traffic-control plan.
C. Posting. The City Engineer is hereby directed to post signage in the locations described in Subsection
A.
D. Marking. The City Engineer shall mark the school zone, as necessary, to define the school zone created by Subsection
A.
A. Weights set.
(1) East Leroy Avenue Bridge. No person shall operate
a vehicle on the highway bridge on East Leroy Avenue over the Chicago
and Northwestern Transportation Company railroad tracks whose gross
weight, including vehicle, cargo and occupants, exceeds six tons.
(2) East Norwich Avenue Bridge. No person shall operate
a vehicle on the highway bridge on East Norwich Avenue over the Chicago
and Northwestern Transportation Company railroad tracks whose gross
weight, including vehicle, cargo and occupants, exceeds four tons.
(3) East Tripoli Avenue Bridge. No person shall operate
a vehicle on the highway bridge on East Tripoli Avenue over the Chicago
and Northwestern Transportation Company railroad tracks whose gross
weight, including vehicle, cargo and occupants, exceeds 10 tons.
B. Enforcement. Any traffic officer having reason to
believe that the gross weight of a vehicle is unlawful or in excess
of the above gross weight limitations may require the operator of
such vehicle to stop and submit the vehicle and any load it may be
carrying to a weighing by means of either portable or stationary scales
and may require that such vehicle be driven to the nearest usable
certified scale. No operator of a vehicle shall fail or refuse to
stop and submit the vehicle and load to a weighing or to drive the
vehicle to a scale when directed to do so by a traffic officer.
Chapter Trans 305 of the rules of the State
Department of Transportation, Division of Motor Vehicles, of the Wisconsin
Administrative Code, is adopted by reference as part of this chapter
as though fully set forth herein.
The City Engineer shall procure, erect and maintain
appropriate standard traffic signs, signals and markings conforming
to the rules of the State Traffic Control Devices Manual giving notice
of the provisions of this chapter as required by state law. Signs
shall be erected in such location and manner as the City Engineer
determines shall best effect the purposes of this chapter and give
adequate warning to users of the streets or highways.
A. There are hereby established traffic control signals
(lights) at the following intersections:
(1) East Layton and South Brust Avenues.
(2) East Layton and South Pennsylvania Avenues.
(3) East Layton and South Whitnall Avenues.
(4) East Layton and South Nicholson Avenues.
(5) South Whitnall and South Pennsylvania Avenues.
(6) South Kinnickinnic and East St. Francis Avenues.
(7) East Howard Avenue and South Packard Avenue, in a
responsive closed loop system.

to make a proper right turn on a red light at the above intersections,
a turn on red shall be prohibited at the following traffic control

to westbound East Howard Avenue, vehicles over three tons.
B. A sign warning motor vehicles of the location of the

Pursuant to the authority granted in § 349.135,
Wis. Stats.:
A. Except as provided in § 347.38(1), Wis.
Stats., no person may operate or park, stop or leave standing a motor
vehicle while using a radio or other electric sound amplification
device emitting sound from the vehicle that is clearly audible under
normal conditions from a distance of 50 or more feet, unless the electric
sound amplification device is being used to request assistance or
warn against an unsafe condition.
B. This section does not apply to the following:
(1) The operator of an authorized emergency vehicle when
responding to an emergency call or when in the pursuit of an actual
or suspected violator of the law or when responding to but not upon
returning from a fire alarm.
(2) The operator of a public utility, as defined in § 11.40(1)(a),
Wis. Stats.
(3) The operator of a vehicle that is being used for advertising
purposes.
(4) The operator of a vehicle that is being used in a
community event or celebration, procession or assemblage.
(5) The activation of a theft alarm signal device.
(6) The operator of a motorcycle being operated outside
of a business or residence district.
A. It shall be unlawful for any person to operate or
ride a skateboard, roller skates, roller skis, roller blades, play
vehicle as defined in § 340.01, Wis. Stats., or similar
devices in any of the following places:
(2) On any sidewalk in any business district. For the
purpose of this section "business district" shall be defined as any
area primarily commercial in nature.
(3) In any public parking ramp or parking lot.
(4) On any public property where signs prohibit it.
(5) On any private property, unless permission has been
received from the owner, lessee or person in charge of that property.
B. Operators or riders of the devices listed in Subsection
A above shall yield the right-of-way to other pedestrians using City sidewalks and shall not otherwise endanger or interfere with pedestrian traffic on those sidewalks.
If it is discovered that a vehicle's registration
plates have been suspended by the State of Wisconsin, or its appropriate
agency, such registration plates may be confiscated by any police
officer. Such plates shall be held for not less than 30 days. If such
registration becomes valid, the plates shall be returned to the lawful
owner of the vehicle. If after 30 days there has been no contact with
the Police Department seeking return of the registration plates, they
may either be returned to the issuing agency or destroyed.
The penalty for violation of any provision of
this chapter shall be a forfeiture as hereafter provided together
with costs under § 345.27, Wis. Stats., and a penalty assessment,
where applicable, as required under § 757.05, Wis. Stats.
A. State forfeiture statutes. Any forfeiture for violation of §
435-1 shall conform to the forfeiture permitted to be imposed for violation of the statutes adopted by reference, including any variations or increases for subsequent offenses.
B. Local regulations. Except as otherwise provided in this chapter, the penalty for violation of §§
435-2 to
435-19 of this chapter shall be as provided in §
1-4 of this Code.
C. Parking violations. Refer to state and City deposit
schedules.
A. Enforcement procedure. This chapter shall be enforced
according to § 66.0114, Ch. 800 and §§ 345.20
to 345.53, Wis. Stats.
B. Deposit.
(1) Any person arrested for a violation of this chapter
may make a deposit of money as directed by the arresting officer at
the police station or at the office of the clerk of court or by mailing
the deposit to such places. The arresting officer or the person receiving
the deposit shall comply with § 343.27, Wis. Stats., or, if the deposit is mailed, the signed statement required
under § 343.27 shall be mailed with the deposit. The arresting
officer or the person receiving the deposit shall notify the arrested
person, orally or in writing, that if he fails to appear in court
at the time fixed in the citation, and if the court does not accept
the deposit as a forfeiture, he will be summoned into court to answer
the complaint.
(2) The amount of the deposit shall be determined in accordance
with the deposit schedule established by the Board of County Judges
and shall include the penalty assessment established under § 757.05,
Wis. Stats., court costs and suit tax. If a deposit schedule has not
been established, the arresting officer shall require the alleged
offender to deposit the forfeiture established by the Chief of Police,
which shall include the ten-percent penalty assessment established
under § 757.05, Wis. Stats. Deposits for nonmoving violations
shall not include the penalty assessment.
(3) The arresting officer or the person receiving the
deposit shall issue the arrested person a receipt therefor as required
by § 345.26(3)(b), Wis. Stats.
C. Stipulation of no contest. Any person charged with a violation of this chapter, except §§ 346.62(1) and 346.63(1), Wis. Stats., may make a stipulation of no contest pursuant to § 345.27, Wis. Stats., which shall be received at the police station or the office of the clerk of court within 10 days of the date of the alleged violation. Such person shall, at the time of entering into the stipulation, make the deposit required under Subsection
B if he has not already done so. A person who has mailed or filed a stipulation under this subsection may, however, appear in court on the appearance date and may be relieved from the stipulation for cause shown as required in § 345.37, Wis. Stats.
