For the purpose of this chapter, the following definitions shall
apply unless the context clearly indicates or requires a different
meaning.
BUFFER ZONES.
The five-foot area located within and along the outer perimeter
of a boundary line around lots of one acre or more.
CITY.
The City of Ivanhoe, Texas.
HARVESTING OF TIMBER
The cutting of trees for the sole purpose of sale or conversion
to lumber to sell.
PERSON.
An individual, firm, corporation, association, or other legal
entity.

(A) No
permit is required for dead, diseased, or trees in danger of falling
which could cause damage to public or private property.
(B) No
permit is required for removal of underbrush or invasive plants.
(C) No
permit is required for trees with a trunk size less than 6" diameter
when measured 4'6" from the ground.

(A) Healthy
trees with a trunk size of 6" or greater diameter when measured 4'-6"
from the ground.
(B) A valid
reason to remove trees over 6" diameter, when measured 4'-6" from
the ground is required to justify the request for a permit.

(A) There
shall be no harvesting of timber in the city. Harvesting of trees
is defined as the cutting of trees for the sole purpose of sale or
conversion to lumber.
(B) Timber
removed in conjunction with a valid building permit on a lot may be
sold or converted to lumber to sell.

The city may require a property owner to remove or prune a tree
on private property which threatens the safety of those living their
property or on adjacent lots or which could fall on a street bordering
the property.

(A) Clean-up
of debris (tree tops, branches, leaves, and pieces of tree stalk)
would need to be accomplished in 30 days after the permit expires,
or, if a burn ban is in effect during this 30-day period, the time
will be extended to 30 days after the ban is lifted. Refer to Sec.
90.16 Open Burning.
(B) The
site will be inspected after this 30-day period to ensure that the
clean-up has taken place.

The following plants/trees will not be permitted to be planted
in the city:

Any person violating any provision of this chapter will be subject to a fine as noted in section
10.99.
