The word “person,” as used in this Part, shall mean
and include any natural person, partnership, association, or corporation.
In this Part, the singular shall include the plural, the plural shall
include the singular, and the masculine shall include the feminine
and the neuter.

No person shall distribute any advertising matter and/or circulars
in the Borough of Myerstown, whether upon the streets and sidewalks
thereof, or from house to house and/or place to place without first
having obtained a permit which shall be issued by the Borough Manager
or his designated representative upon payment of a fee which shall
be set by resolution of the Borough Council and be for the use of
the Borough. The permits and fees shall be for a single distribution
by one or more individuals on a single day or for periodic distributions
over a calendar year.

No person shall distribute any advertising matter or circulars
in the Borough of Myerstown by casting or scattering the same upon
any of the streets, alleys, sidewalks, or public places in the Borough.
Provided; nothing in this Section shall prohibit any person from handling
any noncommercial literature or other printed matter, upon any of
the streets, sidewalks, or alleys in the Borough, to any person willing
to receive the same.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $25 nor more than
$1,000 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 90 days. Each day that a violation
of this Part continues or each Section of this Part which shall be
found to have been violated shall constitute a separate offense.
