This chapter shall be known and may be cited
as the "Land Subdivision Regulations of the Township of Patton."
This chapter is established for the purpose
of regulating the development of human habitation; to provide for
the harmonious development of the Township, for adequate open spaces,
for proper traffic flows, recreation, light and air and for proper
distribution of population, thereby creating conditions favorable
to the health, safety, morals and general welfare of the citizens.
Anyone owning a tract of land of any size or
shape who plans to divide it into two or more different parcels and/or
uses must file a subdivision plan with the Township.
Unless otherwise expressly stated, the following
terms shall, for the purpose of this chapter, be interpreted as follows:
A. Words in the singular
include the plural and those in the plural include the singular.
B. Words used in
the present tense include the future tense.
C. The words "person"
or "subdivider," and "owner" include a corporation, unincorporated
association and a partnership or other legal entity, as well as an
individual.
D. The word "building"
includes structure and shall be construed as if followed by the phrase
"or part thereof."
E. The word "watercourse"
includes channel, creek, ditch, dry run spring, stream and river.
F. The words "should"
and "may" are permissive; the words "shall" and "will" are mandatory
and directive.
Other terms or words used herein shall be interpreted
or defined as follows:
BICYCLE PARKING SPACE
A physical space that is a minimum of 2.5 feet in width by
six feet in length with a vertical clearance of at least seven feet
that allows for the parking of one bicycle and, if located outside,
is hard surfaced and well drained.

BIKE LOCKER
A lockable enclosure consistent with industry standards that
can hold one bicycle; is made of durable material; is designed to
fully protect the bicycle against rain, snow, and ice; provides secure
protection from theft; opens sufficiently to allow bicyclists easy
access; and is of a character and color that adds aesthetically to
the immediate environment.

BIKE RACK
A device consistent with industry standards that is capable
of supporting a bicycle in a stable position, is made of durable materials,
is no less than 36 inches tall (from base to top of rack) and no less
than 1.5 feet in length, permits the securing of the bicycle frame
and one wheel with a U-shaped lock, and is of a character and color
that adds aesthetically to the immediate environment.

BLOCK
An area bounded by three or more streets.
BUILDING SETBACK LINE
Front yard line, the line within a property defining the
minimum required distance between any building to be erected and an
adjacent right-of-way, or front lot line.
CARTWAY (ROADWAY)
The portion of a street right-of-way, paved or unpaved, intended
for vehicular use.
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at street intersections defined
by lines of sight between points at a given distance from the intersection
of the street center lines.
COMMUNITY WATER SYSTEM
Any public or private water system that serves more than
15 homes or 25 residents and/or is regulated by the Pennsylvania Department
of Environmental Protection.

COMPREHENSIVE PLAN
The Centre Region Comprehensive Policy Plan, as adopted by
the Patton Township Board of Supervisors and/or Official Map or such
other plans, or portions thereof, as may be adopted pursuant to statute,
for the area of the municipality in which the subdivision is located.

COUNTY
The County of Centre, Commonwealth of Pennsylvania.
CROSSWALK (INTERIOR WALK)
A publicly or privately owned right-of-way for pedestrian
use extending from a street into a block or across a block to another
street.
DWELLING UNIT
Any structure, or part thereof, designed to be occupied as
living quarters as a single housekeeping unit.
EASEMENT
A right-of-way granted, but not dedicated, for limited use
or private land for a public or quasi-public purpose and within which
the owner of the property shall not erect any permanent structures,
but shall have the right to make any other use of the land which is
not inconsistent with the rights of the grantee.
ENGINEER
A licensed professional engineer registered by the Commonwealth
of Pennsylvania.
FIRE APPARATUS ACCESS ROAD
A road that provides fire apparatus access from a fire station
to a facility, building or portion thereof. This is a general term
inclusive of all other terms such as "fire lane," "public street,"
"private street," "parking lot lane" and "access roadway."

FIRE CHIEF
The Chief of the Alpha Fire Company or a duly authorized
representative.

FIRE DEPARTMENT CONNECTION
Any hose connection utilized by the Fire Department to supply
water to a built-in fire protection system.

FIRE FLOW
The flow rate in gallons per minute of a water supply, measured
at 20 pounds per square inch (psi) residual pressure, that is available
for fire fighting.

IN-STREET BICYCLE PARKING
A portion of a vehicle parking lane or other area on a roadway
that is set aside for the parking of bicycles.

LAND DEVELOPMENT[Added 8-14-1996 by Ord. No.

Any of the following activities:
A.
The improvement of one lot or two or more contiguous
lots, tracts or parcels of land for any purpose involving:
(1)
A group of two or more residential or nonresidential
buildings, whether proposed initially or cumulatively, or a single
nonresidential building on a lot or lots regardless of the number
of occupants or tenure; or
(2)
The division or allocation of land or space,
whether initially or cumulatively, between or among two or more existing
or prospective occupants by means of or for the purpose of streets,
common areas, leaseholds, condominiums, building groups or other features.
C.
Development in accordance with Section 503(1.1)
[53 § 10503(1.1)] of the Pennsylvania Municipalities Planning
Code."
LONG-TERM BICYCLE PARKING
Bicycle parking that is primarily intended for bicyclists
who need bicycle parking for more than three hours and is fully protected
from the weather.

LOT
A designated parcel, tract or area of land established by
a plat or otherwise as permitted by law and to be used, developed
or built upon as a unit.

LOT AREA
The area contained within the property lines of a lot (as
shown on the plan), excluding space within all streets and within
all permanent drainage easements, but including the areas of all other
easements.
MARKER
A metal pipe or pin of at least 1/2 inch diameter (preferred
3/4 inch or 7/8 inch) and at least twenty-four inches in length (preferred
30 inches to 36 inches).
MONUMENT
A stone or concrete monument with a flat top at least four
inches in diameter or square, containing a copper or brass dowel (plug)
and at least 24 inches in length (preferred 30 inches to 36 inches).
It is recommended that the bottom sides or radius be at least two
inches greater than the top, to minimize movements caused by frost.
NFPA
National Fire Protection Association. A national association
established for the purpose of proposing standards that reduce the
opportunity for injury or death from fire.

PLAN, FINAL
A complete and exact subdivision plan (and including all
required supplementary data), prepared for official recording as required
by statute, to define property rights and proposed streets and other
improvements.
PLAN, MAJOR STREET
That element of the Centre Regional and/or Township Comprehensive
Plan, hereafter adopted, which shall show the general location, alignment
and dimensions, and the identification and classification of existing
and proposed streets, highways and other thoroughfares.
PLAN, OFFICIAL
The Comprehensive Development Policy Plan (Master Plan) and/or
Ultimate Right-of-way Plan and/or Official Map or such other plans,
or portions thereof, as may be adopted, pursuant to statute, for the
area of the municipality in which the subdivision is located.
PLAN, OFFICIAL SEWAGE FACILITIES
A plan for sewage facilities in Patton Township and the Centre
Region prepared and adopted by Patton Township and the other Centre
Region Municipalities under the provisions of the Pennsylvania Sewage
Facilities Act (Act 537), as amended, and approved by the Pennsylvania Department of Environmental
Protection.

PLAN, PRELIMINARY
A tentative subdivision plan (and including all required
supplementary data), in lesser detail than a final plan, showing approximate
proposed street and lot layout as a basis for consideration prior
to preparation of a final plan.
PLAN, RECORD
The copy of the final plan which contains the original endorsements
of the municipality and is intended to be recorded with the Centre
County Recorder of Deeds.

PLAN, SKETCH
An informal plan, not necessarily to exact scale indicating
salient existing features of a tract and its surroundings and the
general layout of a proposed subdivision.
RESERVE STRIP
A parcel of ground in separate (sometimes public) ownership
separating a street from other adjacent properties or from another
street.
RESUBDIVISION
Any replotting or resubdivision of land, limited to changes in lot lines on approved final plan or recorded plan as specified in §
350-18 of this chapter. Other replattings shall be considered as constituting a new subdivision of land. See also "subdivision."
REVERSE FRONTAGE LOT
A lot extending between and having frontage on two generally
parallel streets (excluding service streets) with vehicular access
solely from one street.
RIGHT-OF-WAY
The total width of any land reserved or dedicated as a street,
alley, crosswalk or for any other public purpose.
SANITARY SEWAGE DISPOSAL, COMMUNITY
A sanitary sewage collection system in which sewage is carried
from individual lots by a system of pipes to a temporary central treatment
and disposal plant, generally serving a neighborhood area.
SANITARY SEWAGE DISPOSAL, PUBLIC
A sanitary sewage collection system in which sewage is carried
from individual lots by a system of pipes to a central treatment and
disposal plant.
SEPTIC TANK
A covered watertight settling tank in which raw sewage is
biochemically changed into solid, liquid and gaseous states to facilitate
further treatment and final disposal.
SHARED ACCESS EASEMENT
An easement for the common use of two adjacent parcels to
provide vehicular access from separate driveways to an arterial or
collector street.

SHORT-TERM BICYCLE PARKING
Bicycle parking primarily intended for bicyclists who need
bicycle parking for three hours or less.

SIGHT DISTANCE
The required length of roadway visible to the driver of a
passenger vehicle at any given point on the roadway when the view
is unobstructed by traffic. Sight distance measurement shall be made
from a point 4.5 feet above the center line of the road surface to
a point zero and five-tenths (0.5) foot above the center line of road
surface.
SOIL PERCOLATION TEST
A field test conducted to determine the suitability of the
soil for on-site sanitary sewage disposal facilities by measuring
the absorptive capacity of the soil at a given location and depth.
STREET
Includes street, avenue, boulevard, road, highway, freeway,
parkway, lane, alley, viaduct and any other ways used or intended
to be used by vehicular traffic or pedestrians, whether public or
private. Streets are further classified according to the functions
they perform:

A.
ARTERIALA high volume street with
significant intra-urban traffic, primarily intersected by collectors.
Adjacent land use are primarily commercial and industrial.
B.
COLLECTORA street which serves
to gather traffic from all, types of local streets and distribute
vehicles between arterial and local streets. Adjacent land use are
commercial and residential.
C.
LOCALA street which serves primarily
residential land uses and connects residential driveways to provide
access to collectors.
D.
MINORA local street which will
remain in private ownership and serve no more than five single-family
residences.
SUBDIVIDER
Any individual, copartnership or corporation (or agent authorized
thereby) which undertakes the subdivision of land, as defined by this
chapter, as the owner or equitable owner (or agent authorized thereby)
of the land being subdivided.
SUBDIVISION
The division or redivision of a lot, tract or parcel of land
by any means into two or more lots, tracts, parcels or other divisions
of land including changes in existing lot lines for the purpose, whether
immediate or future, of lease, partition by the court for distribution
to heirs or devisees, transfer of ownership or building or lot development;
provided, however, that the subdivision by lease of land for agricultural
purposes into parcels of more than 10 acres, not involving any new
street or easement of access or any residential dwelling, shall be
exempted. The term "subdivision" includes land development and resubdivision
and, as appropriate in these regulations, shall refer to the process
of subdividing land or to the land subdivided.

SURVEYOR
A licensed surveyor registered by the Commonwealth of Pennsylvania.
TILE DISPOSAL FIELD
A system of open jointed or perforated pipes laid in the
upper strata of the soil to distribute sewage effluent into the soil
for absorption and vaporization.
TOWNSHIP COORDINATOR
A person appointed by the Township Supervisors to check submitted
plans for sufficiency of information as required by this chapter,
and if all information required is present to be responsible for distributing
the submitted plans to the various Authorities, Boards, Commissions
and/or other directly concerned parties.
WATER DISTRIBUTION SYSTEM, COMMUNITY
A system for supplying and distributing water from a common
source to two or more dwellings and/or other buildings within a single
neighborhood.
WATER DISTRIBUTION SYSTEM, PUBLIC
A system for supplying and distributing water from a common
source to dwellings and other buildings, but generally not confined
to one neighborhood.
