The Township recognizes that persons in possession or consumption of an open container of alcohol on any public street, public sidewalk, public parking lot, public parking garage, public alley, public park or public space, represent a danger to the health and welfare of the residents.
This article applies to all persons within the Township.
The provisions of this article are not intended to interfere with, abrogate or annul other rules, regulations or ordinances, including Title 40 (Liquor Code)[1] and Title 75 (Vehicle Code),[2] Pennsylvania Consolidated Statutes. If more stringent requirements concerning possession or consumption of an open container of an alcoholic beverage control are contained in the other rules, regulations or ordinances, the more stringent regulation shall apply.

Unless otherwise expressly stated or the context clearly indicates a different intention, the following terms have the following meanings:
ALCOHOLIC BEVERAGES
Liquor or malt or brewed beverages, as defined herein, or both of them.
LIQUOR
Means and includes spirituous, vinous, fermented or other alcoholic beverages or combination of liquors and mixed liquors, a part of which is spirituous, vinous, fermented or otherwise alcoholic, including all drinks or drinkable liquids, preparations or mixtures and reused, recovered or redistilled denatured alcohol usable for beverage purposes, which contain more than 1% of alcohol by volume.
MALT OR BREWED BEVERAGES
Any beer, lager, lager beer, ale, porter or similar fermented malt beverages containing 1/2 of 1% or more alcohol by volume.
TOWNSHIP
Patton Township, Centre County, Pennsylvania.
Possession/transportation of open containers of alcoholic beverages. It shall be unlawful for any person to possess or transport an open container of alcoholic beverage on any public street, public sidewalk, public alley, public park, public parking lot or public parking garage within the Township, whether such person is on foot or is in or on a vehicle, and whether such vehicle is moving or is stationary.
Any person who shall violate the provisions herein relating to open containers of alcoholic beverages shall, upon conviction thereof, be sentenced to pay a fine of not less than $50 and not more than $500.
The provisions of this article shall be enforced by Township police officers, Township Ordinance Enforcement Officers, and others designated by the Township Manager.
