"Group camping"
means twenty (20) or more people listed on a camping permit not to exceed two hundred (200) persons.
"Hawai'i resident"
is a person with a valid Hawai'i driver's license or a Hawai'i State identification card.
"Lydgate Park camping area"
means the area designated for camping on the map attached hereto as Exhibit A.

"Parking permit placard"
means a two (2) sided hanger-style windshield placard with the international symbol of access on it, issued by the Department of Motor Vehicles for a person who has been certified with a temporary or permanent disability by a practicing physician.
"Person with a disability"
is a person with a disability which limits or impairs the ability to walk, and who, as determined by a licensed practicing physician:
(1) 
Cannot walk two hundred (200) feet without stopping to rest, due to a diagnosed arthritic, neurological, orthopedic, renal, vascular, or oncological condition;
(2) 
Cannot walk without the use of, or assistance from, a brace, cane, crutch, another person, prosthetic device, wheelchair, or other assistive device;
(3) 
Is restricted by lung disease to such an extent that the person's forced (respiratory) expiratory volume for one (1) second, when measured by spirometry, is less than one (1) liter, or the arterial oxygen tension is less than sixty (60) mm/hg on room air at rest;
(4) 
Uses portable oxygen;
(5) 
Has a cardiac condition to the extent that the person's functional limitations are classified in severity as Class III or Class IV according to the standards set by the American Heart Association; or
(6) 
As further defined in Hawai'i Revised Statutes Section 291-51, as amended.
"Service animals"
means any animal individually trained to do work or perform tasks for the benefit of an individual with a disability.
"Special license plates"
means license plates displaying the international symbol of access in a color contrasting to the background and with the same size as the letters and numbers on the plates, issued by the Department of Motor Vehicles to a person whose disability is expected to last for at least four (4) years as certified by a practicing physician.

An Article to establish proper controls over the use of Lydgate Park so that the people will have the optimum use and enjoyment of said park.

This Article shall be known as and may be cited as the "Lydgate Park Camping Ordinance."

(a) 
Any person who camps, erects a tent or constructs any temporary sleeping quarters in the Lydgate Park camping area shall first obtain a camping permit from the Department of Parks and Recreation or any other authorized County agency. No permit shall be required for overnight fishing within the Lydgate Park camping area unless the person is using one of the designated campsites numbered one (1) through thirty-one (31) on the map attached hereto as Exhibit B.

(b) 
Permits shall be issued during the hours of 8:15 a.m. to 4:00 p.m. from the Department of Parks and Recreation or other agency that is designated by the Director of the Department of Parks and Recreation.

The Department of Parks and Recreation shall issue a camping permit on a first come first served basis upon the following terms and conditions:
(a) 
One (1) permit shall be issued for each of the thirty-one (31) numbered camping sites which contains a ten (10) foot by ten (10) foot or twenty (20) foot by twenty (20) foot tent area, or the group campsite.
(b) 
Accessible sites are reserved for a person with a disability.
(1) 
Identification of a qualifying person with a disability requires the individual to provide the County employee authorized by the Director of Parks and Recreation with a current parking permit placard or evidence of special license plates.
(2) 
One (1) of the three (3) accessible camping sites shall be reserved exclusively for a group that includes a person with a disability.
(3) 
In the event all non-accessible sites are taken, a camping permit for an accessible site can be issued to a non-disabled person as long as one (1) accessible site is left available for a person with a disability.
(A) 
In the event one (1) of the accessible sites is issued to a non-disabled person because all other sites, non-accessible and accessible sites, have been issued and a person with a disability requests an accessible site, the person with a disability shall wait until there is a vacancy.
(B) 
Persons with disabilities have first choice of the accessible sites but are not precluded from camping at a non-accessible site.
(c) 
There shall be a maximum of five (5) people per ten (10) foot by ten (10) foot camping site and ten (10) people per twenty (20) foot by twenty (20) foot camping site at any one (1) time. The names of the campers shall be listed on the permit.
(d) 
No permit shall be issued to allow camping and no one shall be allowed to camp for more than five (5) consecutive days at Lydgate Park.
(e) 
The number of days camped at Lydgate Park shall be included in the sixty (60) camping days maximum yearly limit set forth in Section 19-2.4(d).
(f) 
The camping site may be closed for maintenance at the discretion of the Director of Parks and Recreation.
(g) 
Tents, structures and all other personal items shall be placed only on the designated tent areas.
(h) 
A group camping permit includes exclusive use of the group camp pavilion.
(i) 
Each permitted camper shall keep and leave the premises in a sanitary, clean, and orderly condition.
(j) 
Each permitted camper shall display the permit on a tent or structure at all times.
(k) 
Failure to comply with any of the above conditions shall result in the permit being revoked.

The following camping fees shall be collected at the time the permit is issued:
Camping site (Hawai'i residents)
$5.00 per day
Group camping site (Hawai'i residents)
$75.00 per day
Camping site (non-resident)
$25.00 per day
Group camping site (non-resident)
$150.00 per day

Animals, with the exception of service animals, are prohibited from being brought into the camping area. The County park caretaker, or other County employee authorized by the Director of Parks and Recreation, shall summarily revoke the camping permit for noncompliance.

Any person found camping without a permit by the County park caretaker or other County employee authorized by the Director of the Department of Parks and Recreation, may be evicted from the Lydgate Park camping area.

Any person found camping in the Lydgate Park camping area without a camping permit shall be punished by a fine not exceeding one hundred dollars ($100.00). Each day of violation shall be a separate offense.
