The term “ice cream vendor,” as used in this chapter, means every person operating a motor-propelled vehicle used solely or mainly for the transportation and mobile sale of ice cream or other frozen desserts in the city.

No person shall operate as an ice cream vendor unless he first obtains a permit to do so from the police chief.

Each applicant for a permit to operate as an ice cream vendor shall provide the following information on a form supplied by the police chief:
A. 
Full name;
B. 
Address;
C. 
Height, color of eyes and hair;
D. 
Place of birth.
E. 
Places of previous employment for the five years preceding the date of application;
F. 
Whether or not he has been convicted of any felony or misdemeanor involving moral turpitude;
G. 
California driver’s license number.
The application shall be signed by the applicant under penalty for perjury and filed with the police chief.

Each applicant for an ice cream permit shall have his fingerprints taken. The police chief shall also take two photographs of the applicant of a size that may be easily attached to the vendor’s permit. One of such photographs shall be attached to the permit when issued, and shall be carried at all times when operating as a vendor within the city. Such photograph shall be attached to the permit so that it cannot be removed and another photograph substituted without detection. The other photograph shall be filed with the application. The applicant shall be responsible for payment of any state or city fees relating to fingerprinting or photographs.

A fixed fee, per year, for an ice cream vendor’s permit shall be paid to the police department. The fee amount shall be established by resolution adopted by the city council, as amended from time to time.

In those instances where there will be a delay in issuance of a vendor’s permit because of the time necessary to process an application, the police chief may, in the exercise of sound and reasonable discretion, issue a temporary vendor’s permit. A temporary permit may be issued when, in the judgment of the police chief, the applicant is likely to receive a permanent permit. A temporary vendor’s permit shall be in a form prescribed by the police chief and shall be surrendered to the police chief upon issuance of the permanent permit. The temporary permit may be revoked in the same manner and for the same reasons as specified in Section 10.65.090.

Every vendor’s vehicle shall be plainly labeled with painted letters of sufficient size to be readily discernible at a distance of 200 feet with a designation of the owner or trade name under which such owner is operating such vehicle.
