The term “ice cream vendor,”
as used in this chapter, means every person operating a motor-propelled
vehicle used solely or mainly for the transportation and mobile sale
of ice cream or other frozen desserts in the city.

No person shall operate as an ice
cream vendor unless he first obtains a permit to do so from the police
chief.

Each applicant for a permit to operate
as an ice cream vendor shall possess the following qualifications:

Each applicant for a permit to operate
as an ice cream vendor shall provide the following information on
a form supplied by the police chief:
C. Height, color of eyes and hair;
E. Places of previous employment for the five
years preceding the date of application;
F. Whether or not he has been convicted of
any felony or misdemeanor involving moral turpitude;
G. California driver’s license number.
The application shall be signed by
the applicant under penalty for perjury and filed with the police
chief.

Any person knowingly or intentionally
misrepresenting to any officer or employee of the city any material
fact in applying for an ice cream vendor’s permit shall be guilty
of a misdemeanor.

Each applicant for an ice cream permit
shall have his fingerprints taken. The police chief shall also take
two photographs of the applicant of a size that may be easily attached
to the vendor’s permit. One of such photographs shall be attached
to the permit when issued, and shall be carried at all times when
operating as a vendor within the city. Such photograph shall be attached
to the permit so that it cannot be removed and another photograph
substituted without detection. The other photograph shall be filed
with the application. The applicant shall be responsible for payment
of any state or city fees relating to fingerprinting or photographs.

Each vendor shall, upon demand by
any police officer, exhibit his ice cream vendor’s permit and
photography for inspection.

A fixed fee, per year, for an ice
cream vendor’s permit shall be paid to the police department.
The fee amount shall be established by resolution adopted by the city
council, as amended from time to time.

In those instances where there will be a delay in issuance of a vendor’s permit because of the time necessary to process an application, the police chief may, in the exercise of sound and reasonable discretion, issue a temporary vendor’s permit. A temporary permit may be issued when, in the judgment of the police chief, the applicant is likely to receive a permanent permit. A temporary vendor’s permit shall be in a form prescribed by the police chief and shall be surrendered to the police chief upon issuance of the permanent permit. The temporary permit may be revoked in the same manner and for the same reasons as specified in Section
10.65.090.

The police chief, in the exercise
of sound and reasonable discretion, when the public safety and interest
may require, shall refuse to issue an ice cream vendor’s permit,
and shall suspend or revoke any such permit, upon the vendor being
convicted of a violation involving drugs or sex offenses.

Every vendor’s vehicle shall
be plainly labeled with painted letters of sufficient size to be readily
discernible at a distance of 200 feet with a designation of the owner
or trade name under which such owner is operating such vehicle.
