It is unlawful for any person to move a building or over-sized load (both referred to in this chapter as a "building") in or upon the public streets of the city without first having obtaining a building moving permit to do so from the development services director and public works director.

Applications for a building moving permit shall including the following information:
A. 
The type, size, construction characteristics, weight, and dimensions of the building to be moved;
B. 
The current address of the building if it is currently located within the city;
C. 
The date and time of the move;
D. 
The proposed route;
E. 
The address to which the building will be moved if the destination is within the city;
F. 
Any other information requested by the director of public works.

A. 
Each application for a building moving permit shall be accompanied by a surety bond, in a form approved by the city attorney, guaranteeing that the move will be completed and that damages to city property, facilities, or streets will be repaired. The penal sum of the bond shall be an amount determined by the director of public works, but in no event less than $10,000.00.
B. 
Each application for a building moving permit where the building is relocated from a site within the city, whether or not the building is moved to a location within the city, shall be accompanied by a surety bond, in a form approved by the city attorney, guaranteeing that the site from which the building is moved will be secured and made safe after removal of the building. The penal sum of the bond shall be in amount determined by the director of public works.
C. 
Each application for a building moving permit for a building which is moved to a site located within the city, regardless of whether or not the move originated within the city, shall be accompanied by a surety bond, in a form approved by the city attorney, guaranteeing that the building will be placed on a permanent foundation after the move is completed. The penal sum of the bond shall be in an amount determined by the director of public works.
D. 
The bonds required by this section may be consolidated into one bond covering all requirements.

Each application for a building moving permit shall be accompanied by a certificate of insurance evidencing coverage for comprehensive general liability insurance or commercial liability insurance (including, in either case, endorsements for comprehensive form, premises, completed operations, collapse hazard, underground hazard, contractual, broad form property damage, independent contractors' personal injury, and riggers' liability) in an amount not less than $1,000,000.00 each occurrence and $2,000,000.00 aggregate; automobile liability insurance (including endorsements for owned, hired, and rented automobiles or vehicles) in an amount not less than $1,000,000.00 each occurrence and $2,000,000.00 aggregate; and workers' compensation insurance. The certificate shall be in a form approved by the city attorney, and shall provide not less than 30 days prior written notice to the city of its cancellation or modification.

Any person moving a building on the public streets of the city or obtaining a building moving permit shall, and by such action agrees to, defend, indemnify, and hold harmless the city and its officers, agents, and employees from any claim or damages of any nature or description arising out of or connected with the moving of the building.

Any person moving a building on the public streets of the city, or obtaining a building moving permit, shall, and by such action agrees to, waive all claims for damages to persons or property (including the building) which occur during the move arising out of or connected with any act or omission of the city or its employees, including, but not limited to, issuance of the building moving permit.

A. 
An application for a building moving permit shall be accompanied by a fee as established by resolution adopted by the city council, as amended from time to time.
B. 
If the application is approved, the applicant shall pay all costs incurred by the city in moving utilities, street lights, trimming trees, directing traffic, or performing any other work to facilitate the moving of the building.

It is unlawful to violate any of the provisions of this chapter.
