A. 
Any person violating a city ordinance or a provision of this code shall be guilty of a misdemean- or, unless, by the terms of the ordinance the violation is made an infraction.
B. 
Except in cases where a different punishment is prescribed by an ordinance of the city, any person convicted of a misdemeanor for violation of an ordinance of the city is punishable by a fine not to exceed five hundred dollars and/or by imprisonment for a period not to exceed six months.
C. 
Any person convicted of an infraction for violation of an ordinance of the city is punishable as set forth in Government Code Section 36900.
D. 
Every day of any violation of this code or any other ordinance of the city constitutes a new and separate offense. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued or permitted by any such person(s), and he/she shall be punished accordingly.

A. 
In addition to those violations of this code that are deemed infractions, violations of the following enumerated sections of this code may be deemed to be an infraction and may be punished as such, notwithstanding the fact that at the discretion of the city attorney, the violation of any section contained in this subsection may be filed as a misdemeanor. The complaint charging such violation shall specify whether the violation is a misdemeanor or an infraction:

Section 5.04.100(A), failure to obtain a solicitor's permit.

Section 5.04.100(E), soliciting after hours.

Section 5.12.050, unlawful placing of handbills on vacant private property.

Section 5.12.060, unlawful placing of handbills on private property against request.

Section 5.28.020(A), operating a massage business without a conditional use permit (CUP).
9. 
Section 5.28.020(B), failure of a massage employee to obtain a valid massage permit.
10. 
Section 5.28.020(C), administering a massage without a valid massage permit.
11. 
Section 5.28.020(D), unlawfully performing or allowing a prohibited act or acts, unless evidence indicates intent to engage in an act of prostitution.
12. 
Section 5.28.090(A), indecent exposure within a massage establishment, unless evidence indicates intent to engage in an act of prostitution.
13. 
Section 5.28.090(B), contacting a client's genitals during massage, unless evidence indicates intent to engage in an act of prostitution.
14. 
Section 5.28.090(C), administering a massage to an "exposed" client, unless evidence indicates intent to engage in an act of prostitution.
15. 
Section 5.28.090(D), failure to wear an approved smock while administering a massage.
16. 
Section 5.28.090(E), failure to identify a managing employee at a massage establishment.
17. 
Section 5.28.090(F), possessing or consuming alcoholic beverage and/or illegal drugs during hours of operation of a massage establishment.

Section 5.28.090(G), failure to display permits and licenses at a massage establishment.
19. 
Section 5.28.090(H), failure to display "LHPD Inspection Authority" signs at a massage establishment.
20. 
Section 5.28.090(I), failure of a managing employee of a massage establishment to comply with city requirements.
21. 
Section 5.28.090(K), failure of a managing employee of a massage establishment to assure that massage employees are properly certified.
22. 
Section 5.28.090(L), failure of a massage establishment employee to properly notify police of place of residence.
23. 
Section 5.28.090(M), failure of a massage operator to provide massage employees with proper requirements.

Section 5.32.101(A), failure to obtain entertainment permit.

Section 5.32.100, unlawfully allowing billiards after hours.
