The purpose of this article is to address a situation whereas any person within the Village of Birnamwood municipal limits knowingly or intentionally, in public, commits public indecency or displays any lewd and lascivious behavior.
As used in this article, the following terms shall have the meanings indicated:
PUBLIC INDECENCY OR LEWD AND LASCIVIOUS BEHAVIOR
A. 
Defined as, but not limited to, the following occurrences:
(1) 
Committing an indecent act of sexual gratification with another with knowledge that they are in the presence of others.
(2) 
Publicly and indecently exposing one's genitals or pubic area.
(3) 
Appearing in the state of nudity.
B. 
Subsections A(1), (2) and (3) in the definition of "public indecency or lewd and lascivious behavior" do not apply to a mother's breastfeeding of her child.
One who commits any of the offenses in this article may be found guilty of a Class A misdemeanor, being in violation of the Wisconsin Crimes Code (Chs. 938 to 951) § 944.20, Wis. Stats., Lewd and Lascivious Behavior, and subject to the penalties under the law.
