A. 
The Applicant shall present at the Office of the Village Clerk, in duplicate, the application for the consideration of the preliminary layout, together with the 12 prints of the preliminary layout, accompanied by any required fee and deposit. The Village will notify the Applicant of the date and time of the meeting of the Board at which the application will be considered.
B. 
The preliminary layout, street profiles, drainage plan and plat and all procedure relating thereto shall in all respects comply with the provisions of the Village Law, Chapter 176, Zoning, and all applicable laws and regulations, except where variations therefrom may be specifically authorized by the Board.
C. 
The Applicant should be prepared to attend the designated meeting to discuss the preliminary layout. Presentation of a preliminary layout shall not be deemed a submission of the plat for approval. Nothing contained herein shall prohibit the submission of the final plat in lieu of such preliminary layout.
D. 
Pursuant to Village Law § 7-728, the Applicant shall, within 180 days of the filing of the resolution granting approval of the preliminary layout with the Office of the Village Clerk, file in duplicate, the application for the consideration of the final plat, the estimate of the cost of public improvements and utilities, certification from the Village that all conditions required by the resolution granting preliminary layout have been complied with, and the consent of the mortgagee(s) to filing of the plat, together with a certificate of title of an approved title company and in form satisfactory to the Board certifying record title in the name of the applicant, and also six prints of the final plat, accompanied by the fee or deposit which may be required by law. Said application shall be filed with the Clerk at least 20 days before the regular meeting of the Board. If an application for final approval is not submitted to the Board within 180 days, the preliminary layout approval shall be deemed expired. The Applicant may apply for an extension of such period by filing a written request with the Board at least three months prior to the expiration of such period. The Board may extend, for no more than two periods of 90 days each, the time in which an application for approval of the final plat must be submitted to the Board if, in the Board's discretion, such extension is warranted by the particular circumstances, provided, however, that an extension should only be granted if the proposed subdivision fully conforms to the zoning regulations in effect at the time such extension is applied for.
E. 
The Clerk will then arrange for a public hearing at a regular meeting of the Board. The Applicant shall also send notice of public hearing, on forms supplied by the Board, to the adjacent property owners (the addresses to be obtained from the last completed tax roll), and shall file with the Clerk at least five days prior to public hearing an affidavit executed by the Applicant, on a form supplied by the Board, stating the name and address of each person to whom notice was sent and the date when such notice was sent. If the Board shall have no regular meeting date, the Clerk will notify the Applicant when the Board will meet.
F. 
If required improvements and utilities have not been completed under the inspection and to the satisfaction of the Board prior to final approval of the plat, then and in that event, and before such final approval of the plat, the Applicant will be required to file with the Board a surety company bond in an amount determined by the Board and in accordance with the form supplied by the Board, to secure to the Village the actual construction and installation of such improvements required by the Board on such final approval and at a time fixed by the Board and in accordance with the requirements of the Board under these regulations. As to utilities required by the Board on such final approval, the Board may in its sole discretion accept assurance in writing from each public utility company whose facilities are proposed to be installed. When such writing is acceptable, it shall be addressed to the Board and state in substance or effect that such public utility company will make the installations necessary for the furnishing of its services within the time therein specified satisfactory to the Board. There may also be included in determining the amount of such bond the reasonable cost of inspection of such improvements by the Board, the estimated cost for employing a watchman to guard any stormwater drainage or storage basins required to be installed by the Board, the cost of liability insurance and the estimated cost of installation of necessary water supply facilities. There shall be further included in said bond a provision that in the event of a default on the part of the principal, the bonding company shall be liable for, which shall be in addition to the principal amount of the bond, all engineering, legal and other expenses which shall be incurred or likely to be incurred by the Village in the enforcement of the bond and the completion of the public improvements covered by the bond.
G. 
After completion of the foregoing procedure to the satisfaction of the Board and if the Board shall approve the plat, the approval of the Board shall be endorsed thereon, together with the date thereof, over the signature of the Chairman or the Clerk or an alternate designated by resolution of the Board. Prior to such endorsement, the Applicant shall file with the Board five prints of the street profiles and drainage plans as approved by the Commissioner of Public Works of Nassau County and the Village Engineer.
H. 
Within 90 days following the endorsement of final approval by the Board, the Applicant shall file the plat, together with one duplicate tracing, and all the necessary documents to create the lots, with the County Clerk. Three duplicate tracings of the plat shall also be filed with the Office of the Village Clerk. The final approval of any plat not so filed shall expire 90 days from the date of signing by the Board. The Applicant may apply for an extension of such period by filing a written request with the Board at least 30 days prior to the expiration of such period. The Board may extend, for no more than two periods of 90 days each, an extension of time in which all filing requirements must be completed if, in the Board's opinion, such extension is warranted by the particular circumstances.
I. 
In the case of a subdivision plat showing premises located within a town or incorporated Village and subject to the jurisdiction of the Board, the signature of the County Planning Commission or Village Planning Board, as the case may be, must be endorsed on the plat and a certified copy of the approving resolution must be filed at the Office of the Village Clerk before the Board considers such plat.
J. 
All applications for subdivision or partitioning approval shall, upon filing, be referred by the Board to the Board of Appeals of the Village of Sands Point to provide to the Board any advisory comments on the proposed plat and layout of the lots. The Board of Appeals shall provide its comments, if any, prior to the granting of preliminary or final subdivision approval.
A. 
The Applicant shall present at the Office of the Village Clerk, in duplicate, the application for the consideration of the preliminary layout, with eight prints of the preliminary layout showing no new streets, accompanied by any required fee or deposit. The Clerk will notify the Applicant of the date and time of the meeting of the Board at which the application will be considered.
B. 
The Applicant shall be prepared to attend the designated meeting to discuss the preliminary layout. Presentation of a preliminary layout shall not be deemed a submission of the plat for approval.
C. 
At the preliminary informal conferences, the Applicant may be required to submit to the Board, before further consideration of the layout, a topographical map, a grade map of existing streets and a drainage plan.
D. 
If tentative approval of the Board is given to the subdivision of the parcel, the Applicant shall then file with the Office of the Village Clerk an application for final approval accompanied by a plat of the whole property of the Applicant showing the subdivision into lots or parcels, a separate survey of each parcel and a drainage plan (if required) approved by the Village Engineer, each item to be in triplicate.
E. 
If the Board shall approve the subdivision after a public hearing, then a copy of the survey of each parcel shall be filed with the Office of the Village Clerk and the Building Department; if a drainage plan is required and approved, the Applicant shall, upon filing of the application for a building permit, furnish to the Village a surety company bond in such sum as shall have been fixed by the Board, for the construction and installation of the required drainage facilities.
F. 
Pursuant with § 7-728 of the Village Law, the Applicant must obtain certification from the Village that all conditions required by the resolution granting final approval have been complied with within 180 days of its filing with the Office of the Village Clerk. If an Applicant fails to comply with the conditions set for the in the resolution granting such final approval within 180 days, the final approval shall be deemed expired. The Applicant may apply for an extension of such period by filing a written request with the Board at least three months prior to the expiration of such period. The Board may extend, for no more than two periods of 90 days each, the time in which the Applicant must receive certification that all conditions have been complied with, if, in the Board's discretion, such extension is warranted by the particular circumstances, provided, however, that an extension should only be granted if the proposed subdivision fully conforms to the zoning regulations in effect at the time such extension is applied for.
G.

H. 
Pursuant to Real Property Law § 334-a(1)(a), an Applicant seeking subdivision approval resulting in no more than four lots may, upon written application to the Board, apply for a waiver of the filing requirements set forth in § 145-3H of the Village Code.
