It shall be a misdemeanor for any person to shoot or discharge
any gun, pistol, rifle, or other firearm or weapon of any kind into
or within the limits of this city, except within a shooting facility
approved in accordance with the provisions of the Escondido Zoning
Code.

The sale and use of gunpowder or explosives and combinations
of chlorate of potash and sulphur or similar compounds for celebration
purposes is hereby prohibited.

explosives at a swap meet.

A firearms dealer who has fully complied with the provisions
of this section relating to trigger locking or similar devices shall
not be presumed to have made any representation to the transferee
regarding the safety or appropriateness of the use of the trigger
locking or similar device, nor shall the firearms dealer be liable
in any civil action brought against the firearms dealer, to the extent
such liability would be based solely upon the act of furnishing the
trigger locking or similar device to a person in compliance with this
section.

(a) The
provisions of section 17-70 shall not apply to temporary lending transactions
in which the fire-arm does not leave the premises of the firearms
dealer.
(b) The requirements of section 17-70 shall not apply to firearms that are curios or relics, as defined by federal law, Title
27 Code of Federal Regulations section 178.
(c) The
requirements in section 17-70 shall not apply to firearms dealers
when they are involved in private party transfers conducted pursuant
to California
Penal Code section 12082.

The storage or sale of fireworks at wholesale is hereby prohibited,
unless authorized by a permit from the council. Such permit shall
be issued for a period of not exceeding one year.

The sale at retail, exchange, barter, trade, possession or exhibition
of fireworks within this city, except to the persons authorized in
section 17-77 and having the permit therein specified, is hereby prohibited.

The discharge, firing or use of all firecrackers, bombs, rockets,
torpedoes, Roman candles or other fire-works or substances designed
and intended for pyrotechnic display, and of all pistols, canes, cannons,
or other appliances using blank cartridges or caps containing chlorate
of potash mixture within this City, is hereby prohibited; provided
that the council may permit the public display of fireworks by properly
qualified individuals or organized bodies under the direct supervision
of experts in the handling of fireworks.

No person shall, upon or in any of the public streets in this
city, fire any salute with gunpowder or dynamite or by the means commonly
called "anvils" where powder or other explosives are used.

Displays of fireworks permitted in accordance with section 17-77
shall be of such character and so located, discharged or fired, that,
in the opinion of the council, such displays shall not be hazardous
to surrounding property or endanger any person.

Except as otherwise provided in any specific section of this
chapter, violation of any provision of this chapter is an infraction
punishable by:
(1) A
fine not exceeding $100 for a first violation;
(2) A
fine not exceeding $200 for a second violation of the same section
within one year;
(3) A
fine not exceeding $500 for each additional violation of the same
section within one year.
