Any person who constructs or alters a bus stop shelter in the
city right-of-way shall do so in accordance with encroachment permit
provisions of this chapter (sections 23-8 through 23-18). Bus stop
shelters shall also be subject to provisions set forth in the Escondido
Zoning Code. The standards set forth in this article are intended
only to be equal to or greater than those standards for outdoor advertising
of the Outdoor Advertising Act (California Business and Professions
Code Section 5200 et seq.). In any case where this article imposes
a lesser standard than the Outdoor Advertising Act the standard set
forth in the Act shall prevail.

Bus stop shelters shall have overall maximum dimensions of five
and one-half (5-1/2) feet in width and 14 feet in length, and shall
maintain a minimum eight-foot clearance from the sidewalk.

Bus stop shelters constructed pursuant to this section shall
be placed on concrete pad equal in length and width of the overall
dimensions.

Each bus stop shelter constructed pursuant to this section shall
be provided with one trash receptacle.

Each bus stop shelter constructed pursuant to this section shall
be provided with a bench at least six feet in length, which shall
be installed inside the shelter.

Each bus stop shelter constructed pursuant to this section shall
be maintained in a clean and functional condition according to a maintenance
schedule approved by the city.

Any person who removes a preapproved bus stop shelter shall
restore the site to its original condition prior to construction unless
otherwise directed by the city council.
