Every officer or employee compensated on a monthly basis who shall have been in the service of the city for at least one year shall be allowed, in each calendar year, a vacation with full pay of one working day for each month, or major fraction thereof, of service during the preceding calendar year, but not exceeding in all the number of days normally worked by the officer or employee in two calendar weeks, except as provided in Section 3.24.050; provided, however, that no such vacation shall be credited for time during which such officer or employee is absent from duty without pay. Any employee who is laid off during their first year of employment and is then rehired within a one year time period shall have their prior service time earned prior to their layoff apply toward their service time eligibility for vacation benefits earned.

In addition to such other vacations to which he or she may be entitled, and commencing on January 1, 1979, every officer, management employee or employee, except nonmanagement safety employees of the police division and fire division, who has been in the service of the city on or after January 1, 1978, for a total of five years, shall be allowed, after his or her employment/anniversary date, additional vacations based upon the following:

For the purpose of computing the additional vacations allowed by Sections 3.24.020 and 3.24.030, "total service" means and includes all service with the city prior to any resignation or retirement as well as the service of the officer or employee following his or her reemployment.

A. 
All officers and employees shall use all vacation time earned in one calendar year in the first succeeding calendar year except as otherwise provided in this chapter. An officer or employee who is unable to take a vacation in accordance with the first provisions of this section due to the fact that such person's continued service is in the best interests of the city shall, with approval of the person's division head or of the city manager, be entitled to accumulate and take such vacation during the second succeeding calendar year. Accumulation and use of vacation leave beyond any succeeding calendar year may be granted by the city manager, at his or her discretion, in special or unusual circumstances.
B. 
An officer or employee who is unable to return to work due to a serious and prolonged illness or injury which prevents such person from taking earned vacation time during the calendar year, may, with approval of the city manager, carry over such vacation with the next succeeding calendar year. An officer or employee who has been on military leave of absence for at least thirty consecutive days during the calendar year in which such person would otherwise be entitled and required to take a vacation, may take such vacation during the twelve calendar months immediately following the calendar month of termination of such military leave, but in no way shall such officer or employee be entitled to take such vacation or receive any compensation for same after this last stated time. All vacations shall be taken at such time as approved by the employee's division head, or in the case of an officer, by the city manager.

A. 
All public safety employees of the fire division except management employees, compensated on a monthly basis, who have been in the service of the city for at least one year shall be allowed in each calendar year a vacation with full pay based on their assigned schedule: shift assignment—five shifts; nonshift assignment—ten days.
B. 
Those employees who have been in the service of the city for at least ten years shall be allowed in each calendar year a vacation with full pay based on their assigned schedules: shift assignment—seven and one-half shifts; nonshift assignment—fifteen days.
C. 
Effective January 1, 1980, the vacation for those employees with at least ten years service shall be the following: shift assignment—eight shifts; nonshift assignment—sixteen days.
D. 
Those employees who have been in the service of the city for at least twenty years shall be allowed in each calendar year a vacation with full pay based on their assigned schedule: shift assignment—ten shifts; nonshift assignment—twenty days; provided, however, that no such vacation shall be credited for time during which such employee is absent from duty without pay.

The city manager shall be allowed in each calendar year a vacation with full pay of twenty working days and the preceding sections of this chapter, except Section 3.24.050, shall not apply.
