A. 
No person shall engage in the business or in any act of collecting, processing, transporting, recycling or disposal of solid waste originating in the Village without first having obtained, and having currently in force, a solid waste handler's license issued by the Village.
B. 
No person shall operate a motor vehicle on the public streets or highways within the Village in connection with any business or in the performance of any act specified in Subsection A hereof unless there shall be displayed prominently on such motor vehicle an official emblem or other evidence of the issuance of a solid waste handler's license to the owner or lessee of said motor vehicle, furnished by the Village Clerk under the terms of this chapter, and permanently affixed to such motor vehicle.
C. 
Notwithstanding the foregoing, this section shall not preclude or limit the access to or use of any public streets or highways by such vehicle for the sole purpose of transporting or passing through the Village in order to collect or dispose of such solid waste somewhere outside the Village.
D. 
The requirements and prohibitions of this section shall not apply to any governmental agency or entity operating in accordance with the laws of the State of New York.
Each applicant for a solid waste handler's license shall file with the Village Clerk an application therefor in writing, upon forms prescribed and furnished by the Village Clerk, verified under oath or affirmation, and accompanied by such documents and proof and containing such information, verified under oath or affirmation, as the Board of Trustees may, by rule or regulation, hereafter require. All applications submitted shall be accompanied by payment of such application and license fees as the Board of Trustees may, by resolution, from time to time prescribe. Permits are effective for the calendar year. Renewal applications will be sent to each permit holder prior to the expiration thereof, but it is the licensee's responsibility to ensure that the license is current. The Village Clerk shall be responsible for determining whether the applicant or renewal applicant has met all requirements and documentation prescribed by the Board of Trustees.
All licenses issued under this article shall be nontransferable. Any attempt by a license to transfer its license (including by operation of law) shall render the license void.
The Board of Trustees shall determine by resolution the required fees and the grounds for suspension or revocation of licenses. The Board of Trustees is further responsible for providing a right of appeal to those individuals who have been denied a license or renewal license, or whose license has been suspended or revoked. Such review shall be conducted by the Board Trustees, provided that an application therefor is filed with the Village Clerk within 20 days after notice of the denial or refusal to renew any such license or of the suspension or revocation of such license. Subject to judicial review, the determination of the Board of Trustees with respect to such review shall be final. The Board of Trustees may from time to time, by resolution, establish a Solid Waste Management Commission or other board or commission, the responsibilities of which shall also be established by the Board of Trustees at that time, and may delegate, by resolution, certain rulemaking or supervisory authority to such board or commission. In addition to enforcement under Article III herein, the Board of Trustees shall also have the power to bring a civil action in a court of competent jurisdiction to restrain any violation of this Article II. This shall not restrict the Village from pursuing any other legal remedy.
