There is hereby established for Sacramento County a pretrial release program as provided in this chapter.

The Pretrial Release Program Manager, referred to in this chapter as "Manager," shall be a non-civil service position established in the Sacramento Municipal Court District to supervise the Sacramento County Pretrial Release Program. The appointing authority for the position shall be the Municipal Court and the person appointed shall serve at the pleasure of said court.

The Pretrial Release Program shall be supervised exclusively by the Municipal Court. A Pretrial Release Advisory Board is hereby established and may meet at the request of the Presiding Judge of the Municipal Court or on its own motion. Said Board shall be advisory only and the Municipal Court shall not be bound in any way by any recommendation of said Board. The members of said Board shall be selected and shall serve as provided in this section.

One Superior Court judge to be permanently assigned by the Presiding Judge for at least one year.
b. 
One Municipal Court judge to be permanently assigned by the Presiding Judge for at least one year.
c. 
The Sheriff or designated representative.
d. 
The District Attorney or designated representative.
e. 
The Public Defender or designated representative.
f. 
The Chief Probation Officer or designated representative.
g. 
The Sacramento City Chief of Police or designated representative.
h. 
A representative of the California Highway Patrol.
i. 
A representative of the Sacramento County Bar Association to be appointed by the President of the County Bar Association for a one-year term.
j. 
A non-lawyer citizen member who shall serve as Chair of the Board to be appointed for a two-year term by the President of the Sacramento Metropolitan Chamber of Commerce.

The Manager shall be responsible for developing goals and objectives, policies, and operating procedures for the operation of Sacramento County's Pretrial Release Program. After approval by the Municipal Court the policies and procedures shall be implemented by the Manager and the employees assigned to the Pretrial Release Program.

The Manager shall develop a program to recommend release on recognizance (ROR) for felons. After approval by the Municipal Court this program shall be followed by the Manager and the employees assigned to the Pretrial Release Program in processing defendants charges with crimes for consideration of felony ROR. The initial primary responsibility of the Manager shall be to make recommendations relating to ROR for felons. The Manager may thereafter make recommendations relating to pretrial release for other inmates subject to approval by the Municipal Court.
