Any person who keeps, possesses or maintains an animal within the City shall comply with the requirements of this chapter and the failure to so comply shall be unlawful.

There is hereby adopted, by reference, by the City of Encinitas, for the purpose of prescribing rules and regulations for the protection of the public health and safety, the following portions of the San Diego County Code together with such secondary references as set forth in this chapter. The provisions of the San Diego County Code and future amendments shall be controlling within the limits of the City of Encinitas to include without limitation, the fees, regulatory provisions, and definitions, and only those procedural provisions for processing applications, conducting investigations, issuing permits and enforcing regulatory provisions; excluding all other procedural provisions:
A. 
Title 6, Division 2, Chapter 1, regulating livestock;
B. 
Title 6, Division 2, Chapter 3, relating to strays on military property;
C. 
Title 6, Division 2, Chapter 6, relating to rabies, animal control and regulations;
D. 
Title 6, Division 2, Chapter 7, relating to animals in vehicles;
E. 
Title 6, Division 2, Chapter 8, relating to the disposal of dead animals; and
F. 
Title 6, Division 2, Chapter 9, relating to bees.

The City of Encinitas contract service provider together with the County veterinarian is hereby designated as the veterinarian for the City of Encinitas with authority to enforce and observe within the City of Encinitas the following:
A. 
All orders, quarantine regulations, statutes and rules and regulations issued by the State of California relating to animal control.
B. 
Those portions of the San Diego County Code pertaining to animal control as are set forth in this chapter.

A. 
Each applicant for a license or permit required by this chapter shall apply to the City of Encinitas contract service provider or their designated agent.
B. 
The City of Encinitas contract service provider or their designated agent shall collect and retain for the benefit of the contract service provider the fees and payments imposed by this chapter.

It is unlawful for any person to set, trigger, activate or otherwise use or cause to be set, triggered, activated or used any leg-hold trap within the City of Encinitas. A leg-hold trap is any spring-powered device used to trap animals which has metal jaws that clamp shut on an animal's leg or other body part when the animal steps on or comes in contact with the trap's pressure sensitive trigger. This section is not intended to regulate the use of spring loaded traps designed to kill gophers, rats, mice and other small rodents.

A. 
Purpose. Supplemental regulations governing the keeping of dogs are intended to provide for the compatibility between such animals and neighboring land uses. These are in addition to the general requirements governing animals established by the City of Encinitas Municipal Code.
B. 
Dogs. In residential zoning districts, or in conjunction with any residential uses in any other zoning district, not more than six dogs per parcel shall be permitted, with the following exception:
1. 
Newborn and baby animals up to the age of four months shall not be counted in determining compliance with the numerical limits of this subsection.
