District fire hydrants may be used to supply construction water
or other temporary water in the manner provided in this Article. Such
use shall be limited to a one-year term and may be extended by determination
of the General Manager. Backflow protection may be required as determined
by the General Manager. Recycled water may be required for use in
lieu of potable water for construction water where available, as determined
by the General Manager.

Any person desiring to utilize a fire hydrant for construction
or other temporary water use shall file an application for installation
of a construction meter on forms provided by the District.

A deposit shall be paid to the District at the time of the application
which shall be used for the following purposes:
(a) A deposit against loss or damage to the construction meter or hydrant,
which shall be refunded if there is no loss or damage.
(b) A fee for installation, which shall not be refundable.
(c) A “use” fee to be put into an account kept for the purpose
of repairs on hydrants within this District.
(d) A deposit for water charges.
The amount of the deposit is established by the District and
set forth in Appendix A (Rates and Charges). The deposit will be refunded
upon return of the meter in good condition less the rental fee, the
installation charge and the cost of water used. No interest shall
be paid on the amount refunded.

Water rates shall be established by the Board of Directors and
are set forth in Appendix A (Rates and Charges).

The meter shall be located on the fire hydrant designated by
the District. If relocation from one hydrant to another is required,
this shall be accomplished by a District employee at a charge established
by the District as set forth in Appendix B (Engineering Fees). Roving
meters may not be used unless expressly approved in writing by the
General Manager.

The applicant is responsible for any damage to the fire hydrant
and the construction meter. Applicant shall not operate the fire hydrant
valve but shall use only the valve on the meter discharge. Waste of
water is prohibited and shall be grounds for the District’s
removal of the meter and discontinuance of use of the fire hydrant
for construction water.

When the meter is no longer required, the applicant shall notify
the District thereof, and District shall disconnect and remove the
meter.

The District shall notify the Encinitas Fire Department of the
installation and removal of any meter attached to a District fire
hydrant.

A penalty, in an amount established by the Board of Directors
as set forth in Appendix A (Rates and Charges), plus a charge for
an estimate of water used will be assessed to anyone taking water
in violation of the above rules, plus any other remedies available
to the District. The same party having subsequent violations will
be charged an increased fee for each subsequent violation.
