Fire hydrants on District lines are the property of the District.

Subject to Section 24.4, whenever the District installs a new water main, it shall also install, at its own expense, such fire hydrants, as it deems beneficial to provide fire protection service to the area. Prior to such installation, the District shall consult with the Encinitas Fire Department (“fire agency”), but the District shall be the sole judge of the number, size and location of such fire hydrants.

Whenever property is rezoned, subdivided or otherwise developed, the owner or developer shall pay for the installation of such fire hydrants, as the fire agency shall determine.

The District shall install additional fire hydrants, or upgrade existing fire hydrants, on existing lines of the District upon request of the fire agency, developer or property owner, provided the District determines that it has facilities to supply adequate water thereto, and the organization requesting installation pays for the installation thereof.

Repairs of fire hydrants shall be accomplished by the District. The fire agency shall maintain access to the hydrants, exercise the hydrant valves, remove weeds, paint hydrants, and place reflectors on the pavement.

No person, other than the District or the fire agency, shall use a District hydrant for any purpose without the express written consent of the District. Fire hydrants may be used for construction purposes in the manner provided in Article 20 (Construction Water).

Nothing provided in this Article shall obligate the District to install any particular fire hydrant. Nothing provided herein shall give any rights to third parties or increase or otherwise change the liabilities or responsibilities of the District to property owners or other members of the public.

The property owner is responsible for the installation of the lateral from the District’s valve, the Reduced Pressure Principle Assembly (RPPA) and the fire hydrant. The District is responsible for the maintenance of the lateral up to the property line. The property owner is responsible for the maintenance of the lateral from the property line to and including the RPPA and fire hydrant. The RPPA is tested annually in the manner provided in Article 18 (Cross-Connection and Backflow Prevention).
