A. 
This chapter shall be known as the "Barrington Land Development and Subdivision Regulations" or "Chapter 200 of the Code of the Town of Barrington." It shall be applicable in all cases of subdivision of land; in all cases of land development projects as provided for in § 45-24-47 of the Zoning Enabling Act of 1991; and in all cases of development plan review, as provided for in § 45-24-49 of the Zoning Enabling Act of 1991.
B. 
Notwithstanding the statement in Subsection A above, however, these regulations shall not apply to those applications submitted under the Barrington Zoning Ordinance, Article XXIV, Development Plan Review, § 185-157, relating to sign review.
C. 
These regulations shall not apply to lawful preexisting developments. Nothing in these regulations shall impact the continuation of lawful preexisting developments or use of land which are nonconforming in standards of design or required improvements to the land.
In accordance with the provisions of the Land Development and Subdivision Review Enabling Act of 1992, Chapter 45-23 of the General Laws of Rhode Island, as amended, and with Ordinance No. 94-16 adopted by the Barrington Town Council on September 19, 1994, the Barrington Town Planning Board hereby adopts the following regulations governing land development and the subdivision of land. All prior regulations governing such subdivision of land and all prior amendments thereto are hereby repealed.
A. 
The land development and subdivision regulations set forth in this chapter have been made in accordance with the Barrington Comprehensive Plan, adopted or amended pursuant to Title 45 Chapter 22.2 of the General Laws of Rhode Island, with the Barrington Zoning Ordinance, Chapter 185 of the Code of the Town of Barrington, adopted or amended pursuant to Title 45 Chapter 24 of the General Laws of Rhode Island, and with other duly adopted statutes and local development regulations.
B. 
In the instance of uncertainty in the construction or application of any section of these regulations, the regulations shall be construed in a manner that will further the implementation of, and not be contrary to, the goals and policies and applicable elements of the Comprehensive Plan. Furthermore, these regulations shall be construed in a manner which is consistent with the legislative findings, intents and purposes of §§ 45-23-25 through 45-23-74 of the Land Development and Subdivision Review Enabling Act of 1992.
These regulations are designed to:
A. 
Provide for the orderly, thorough and expeditious review and approval of land developments and subdivisions;
B. 
Promote high quality and appropriate design and construction of land developments and subdivisions;
C. 
Promote the protection of the existing natural and built environment and the mitigation of all significant negative impacts of any proposed development on the existing environment;
D. 
Promote design of land developments and subdivisions which are well-integrated with the surrounding neighborhoods with regard to natural and built features, and which concentrate development in areas which can best support intensive use by reason of natural characteristics and existing infrastructure;
E. 
Encourage local design and improvement standards to reflect the intent of the Comprehensive Plan with regards to the physical character of the various neighborhoods and districts of the Town of Barrington;
F. 
Promote thorough technical review of all proposed land developments and subdivisions by appropriate local officials;
G. 
Encourage local requirements for dedications of public land, impact mitigation, and payment in lieu thereof, based on clear documentation of needs and fairly applied and administered; and
H. 
Encourage the establishment and consistent application of procedures for local recordkeeping on all matters of land development and subdivision review, approval and construction.
