There shall be an Arts, Humanities and Events Council Committee that shall oversee the commissions, committees and boards of the Borough of South River related to the arts, humanities and Borough events. The Arts, Humanities and Events Council Committee shall consist of three members of the Borough Council, one of whom shall be designated Chairman, and who shall be appointed at the annual organizational meeting in accordance with the Rules of Council. Initial appointments to the Arts, Humanities and Events Council Committee shall be made at the first regular meeting following the effective date of this chapter. The Arts, Humanities and Events Council Committee shall exercise supervision and control over the Municipal Cultural Arts and Heritage Commission and Parks and Recreation Advisory Board and such other agencies, officers or employees of the Borough as may be designated from time to time by the Borough Council.
There is hereby created a Municipal Cultural Arts and Heritage Commission.
The Municipal Cultural Arts and Heritage Commission consists of nine regular members. At least two regular members shall be from among the following arts and professions: painting, sculpture, music, literature, landscape and landscape architecture. At least one regular member shall be learned in the historic or architectural traditions of the Borough of South River. All members shall serve without compensation. The members of the Commission who are first appointed shall be designated to serve for terms of one, two, three, four and five years, respectively, from the date of their appointments, but thereafter, members shall be appointed for a term of five years, except that all vacancies shall be filled for the duration of the unexpired term only. The term of office of members of the Commission shall commence on January 1 of each year. Appointments shall be made by the Mayor with the advice and consent of the Borough Council. All members shall be citizens and residents of the Borough of South River.
A. 
Alternate members shall be designated, at the time of appointment, as "Alternate No. 1" and "Alternate No. 2." The terms of the alternate members shall be five years. A vacancy occurring otherwise than by the expiration of a term shall be filled by the appointment of the Mayor for the unexpired term only.
B. 
Alternate members may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. No vote shall be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.
A. 
One of the members shall be elected by the members of the Commission as Chairman; the Commission shall also elect a Vice Chairman and Secretary.
B. 
The Commission shall conduct 10 monthly meetings annually at a date and time to be determined, for which minutes shall be recorded by the Secretary as set forth in the bylaws of said Commission.
The Commission shall have the power and duty to:

Review and report to the Mayor and Borough Council upon any acquisition or disposition by the Borough and any placement on or removal from any property of the Borough of works of art, prior to any such acquisition, disposition, placement or removal. The term "works of art" shall include but shall not be limited to paintings, mural decorations, stained glass, statues, bas-reliefs or other sculptures, monuments, fountains, arches or other structures of a permanent or temporary character intended for ornament or commemoration.
B. 
Review and report to the Mayor and Borough Council upon the design of buildings, bridges, viaducts, elevated ways, gates, fences, lamp standards or other structures erected on or to be erected on any property of the Borough of South River and upon the design of arches, bridges, structures and approaches which are the property of any corporation or private individual and which are to be erected so as to extend over or upon any street, avenue, highway, park or other public place of the Borough of South River prior to the approval of such design or erection.
C. 
Prepare and maintain a roster of sites and structures in the Borough of South River of historic significance and recommend to the Mayor and Borough Council measures for the preservation of any structure on said roster, including the acquisition and maintenance of an historical site, pursuant to N.J.S.A. 40:60-25.53.
D. 
Consult with owners of private property in relation to the beautification of such property and with respect to the plans and designs or sketches of proposed improvements thereto.
E. 
Act in an advisory capacity to the Mayor and Borough Council in connection with the artistic and cultural development of the Borough of South River.
F. 
Promote and help plan activities such as parades, exhibits, or similar type events to commemorate the heritage of the Borough as well as contributions made by its residents.
Section 22-7 et seq. shall in no way be construed to deprive any other board or body of the Borough of South River, including the Mayor and Borough Council, of any jurisdiction to act upon any matter set forth in this article by virtue of any of the provisions of this article, which provisions shall be deemed to be directory only.
There is hereby created a Parks and Recreation Advisory Board.
The purpose of the Parks and Recreation Advisory Board shall be to assist the governing body in making determinations with respect to the control of the recreation and recreational places for the residents of the Borough. In addition, the Advisory Board shall investigate, research and report to the governing body with respect to any programs and/or events said Board feels should be added or deleted with respect to the parks and recreation of the Borough of South River. The Board shall also recommend to the governing body the appropriate fees to be charged for use of Borough parks and registration with Borough recreation programs. The governing body shall from time to time by resolution authorize any change in such fees.

The Parks and Recreation Advisory Board shall consist of six members, who shall reside within the Borough of South River. The members of the Board shall serve without compensation. The Board shall annually, upon reorganization, elect a Chairman from its regular voting members.
B. 
The Parks and Recreation Advisory Board shall consist of six voting members, the Recreation Director and a member of the Borough Council as liaison to the Board. The Borough of South River Mayor with the advice and consent of the Borough Council shall appoint six Borough residents as the voting members. Each voting member of the Board shall serve for a three-year term. In the event of the tie in any vote, the Borough Council liaison shall vote to break the tie.
C. 
Mandatory background checks for all volunteers, staff and independent contractors of Borough that participate in youth programs. In order to ensure the safety and well-being of the Borough's youth, an annual mandatory background check will be required for all volunteers, staff and any independent contractors of the Borough that participate in Parks and Recreation youth programs.
(1) 
All background checks will be carried out in accordance with N.J.S.A. 15A:3A-1 et seq.
(2) 
Any person shall be excluded from volunteer and/or staff participation in the Parks and Recreation youth programs if the background check reveals a record of conviction of any of the crimes and offenses listed in N.J.S.A. 15A:3A-3.
(3) 
All background checks shall be sent to the Recreation Director for inspection and review. The Director shall submit his/her review to the Borough Administrator.
(4) 
The prospective volunteer, staff member or independent contractor shall be notified of a disqualification, in writing, by the Borough Administrator.
The Parks and Recreation Advisory Board shall provide, at the very minimum, an annual report with recommendations to the Recreation Director and Borough Council liaison. Said report shall be provided in November of each calendar year with the recommendations the Advisory Board deems appropriate and necessary. The mandatory report shall be filed in November to allow the Recreation Director and Borough Council liaison to review the same and make the appropriate determinations and take appropriate action with respect to the programs for the new calendar year. Nothing herein shall restrict the Parks and Recreation Advisory Board from issuing recommendations and reports on a more frequent basis as deemed necessary by the Parks and Recreation Advisory Board. A copy of the agenda and minutes from each meeting of the Board shall be provided to the Recreation Director and Borough Council liaison.
