The Village Manager and Fire Department must promptly cause
a copy of this chapter, and a copy of any amendment thereafter to
same, and a copy of the Code of Ethics, and any amendment thereto
to be posted in each building under the Fire Department's control.
Any officer, member or employee of the Fire Department who violates
this chapter may be fined, suspended or removed from office, employment
or membership in the Fire Department in a manner provided by law.
A violation of this chapter is deemed "misconduct" within the meaning
of § 209-1 of General Municipal Law.
If any clause, sentence, paragraph, subdivision, section or
part of this chapter or the application thereof to any person, individual,
corporation, firm, partnership, entity or circumstances is adjudged
invalid or unconstitutional by any court of competent jurisdiction,
such order or judgment shall be confined in its operation to the clause,
sentence, paragraph, subdivision, section or part of this chapter
or in its application directly involved in the controversy in which
such judgment shall have been rendered and shall not affect or impair
the validity of the remainder of this chapter or the application thereof
to other persons or circumstances. Further, in adjudging such invalid
provision, the court shall attempt to modify same to a provision which
is not invalid or unconstitutional and which best achieves the intent
of the invalid provision.
Any local law, ordinance or resolution of the Village in conflict
herewith is hereby repealed to the extent of such conflict or inconsistency,
except that this repeal shall not effect or prevent the prosecution
or punishment of any person for any act done or committed in violation
of any local law, ordinance or regulation hereby by repealed prior
to the effective date of this chapter.
This chapter shall take effect upon the filing with the Secretary
of State.
