[HISTORY: Adopted by the Board of Supervisors of the Township
of Franconia 5-20-2024 by Ord. No. 425. Amendments noted where applicable.]
The International Property Maintenance Code, 2021 Edition, as
amended from time to time, as published by the International Code
Council, is hereby adopted and incorporated herein by reference as
the Property Maintenance Code of this Township, with the following
revisions:
A.
The phrase "Franconia Township" is hereby added to § 101.1
thereof.
B.
The phrase "Code Enforcement" is hereby added to § 103.1
thereof.
C.
Section 109.4 thereof is amended to read as follows:
"Penalties. Any person who shall violate a provision of this
code, or fail to comply therewith, or with any of the requirements
thereof, shall, upon being liable therefor in a civil enforcement
proceeding commenced by the township, pay a fine not exceeding $1,000
plus all court costs, including reasonable attorney's fees incurred
by the township. Each day that a violation continues after due notice
has been served shall be deemed a separate offense. If the defendant
neither pays nor timely appeals the judgment, the township may enforce
the judgment pursuant to the applicable Pennsylvania Rules of Civil
Procedure."
D.
There is hereby inserted into the first sentence of § 302.4
the phrase "12 inches."
E.
The period specified in § 304.14 shall be from April 1
to November 1.
F.
The period specified in §§ 602.3 and 602.4 shall be
October 1 to May 1.
