The fee for a construction permit shall be the sum of the subcode
fees listed in Subsections A through E hereof and shall be paid before
the permit is issued.
A. Building subcode. The building subcode fees shall be:
(1) For new construction the fee shall be based upon the volume of the
structure. Volume shall be computed in accordance with N.J.A.C. 5:23-2.28.
The fee for new construction shall be in the amount of $0.052 per
cubic foot of volume for buildings and structures of all use groups
and types of construction of R-3, R-4, R-5 and U, including use groups
A-1, A-2, A-3, E, H, I-1, I-2, I-3, R-1, b, and M. The fee for the
following use groups of F-1, F-2, S-1, S-2, A-4 and A-5 shall be $0.051
per cubic foot of volume.
(2) For reconstruction, renovations, alterations and repairs: $53 per
$1,000 of estimated cost of the work, provided that the minimum fee
shall be $95.
(3) For additions: $0.040 per cubic foot of building or structure volume
for the added portion, provided that the minimum fee shall be $95.
(4) For combinations of renovations and additions: the sum of the fees
computed separately as renovations and additions.
(5) For swimming pools, spas, hot tubs, soaking pools, or other related
equipment of use groups R-3 and R-5 shall be:
(c)
For all other use groups shall be $410 per each structure.
(d)
The fee for replacing barriers surrounding and enclosing swimming
pools required to have barriers shall be $120.
(6) For open area volume buildings, storage, the fee shall be $0.023
per cubic foot of building or structure volume, provided that the
minimum fee shall be $95.
(7) The fee for re-roofing or re-siding for R-5 uses when required shall
be $95 per structure. For all other use groups, the fee shall be computed
at $32 per $1,000 of construction cost, provided that the minimum
fee shall be $160.
(8) The building subcode fee for all solar unit construction for use
groups R-3, R-5 shall be $95. For all other use groups the fee shall
be $160.
(9) The fee for buildings of agricultural uses, commercial Farm buildings
shall be computed at $45 per $1,000 of construction cost, provided
that the minimum fee shall be $95.
(10) The fee for a permit for a demolition of a one-family residence,
R-1, R-5, farm structure, garage, shed, underground fuel oil tank,
aboveground fuel oil tank or other type tanks and all other structures
shall be $95. The fee for demolition of commercial structures shall
be $200.
(11) The fee for a permit for the removal of a building or structure from
one lot to another or to a new location on the same lot shall be $50
per $1,000 of the sum of the estimated costs for moving, for new foundations
and for placement in a completed condition in the new location, provided
that the minimum fee shall be $95.
(12) The fee for a permit to construct a sign shall be $3.50 per square
foot of the surface area of the sign, provided that the minimum fee
shall be $160. In the case of double-faced signs, the area of the
surface of only one side of the sign shall be used for purposes of
the fee computation.
(13) The fee for radon mitigation, lead hazard abatement and asbestos
removal for use groups R-3 and R-5 shall be $160. All other use groups
shall be $280.
(14) For temporary structures, tents in excess of 900 square feet or more
than 30 feet in any dimension shall be $95.
(15) The fees for retaining walls shall be as follows:
(a)
A retaining wall with a surface area of 500 square feet or less
that is associated with a residential structure shall be $95.
(b)
A retaining wall with a surface area greater than 500 square
feet that is associated with a residential structure shall be $200.
(c)
A retaining wall of any size at commercial structures shall
be computed at $45 per $1,000 of construction cost, provided that
the minimum fee shall be $160.
(16) The fee for permits for work done in response to a notice of violation
shall be computed at $60 per $1,000 of construction cost, provided
that the minimum fee shall be $135.
(17) The fee for the issuance of a building subcode permit that has not
been determined in this schedule shall be $95.
B. Plumbing subcode. The plumbing subcode fees shall be:
(1) For the installation, including replacement, of plumbing fixtures,
not in the listed below fee scheduled shall be a minimum of $95.
(2) For the installation, including replacement of the following plumbing
fixtures, the fee shall be:
(a)
Water closet/urinal/bidet: $35.
(p)
Wireless rain sensor: $35.
(q)
Backflow preventer (residential): $70.
(v)
Commercial dishwasher: $70.
(w)
Ejector (residential): $70.

residential property shall be $95 per unit.
(5) Vehicle charging stations: $95 each.

E. Fire protection subcode. The fire protection subcode fees shall be:
(1) For the installation of gasoline, oil, fuel, liquefied petroleum
gas, chemical or miscellaneous storage tanks up to 550 gallon capacity
shall be $95.
(2) Tanks.
(a)
Tanks over 550 and up to 2,500 gallon capacity shall be $147.
(b)
Tanks over 2,500 gallons an additional $21 per 1,000 gallons.
(3) Fire alarms, Fire suppression systems and fire sprinklers, standpipes,
fire pumps, Fire mains:
(a)
For fire-suppression systems or special fire protection systems,
preengineered systems shall be computed at $50 per $1,000 construction
cost, provided that the minimum fee shall be $95.
(b)
For automatic fire sprinkler system, limited area sprinkler
systems shall be computed per sprinkler head:

construction cost, provided that the minimum fee shall be $95.
(5) For each heating units for all use groups the fee shall be computed
at $50 per $1,000 construction cost, provided that the minimum fee
shall be $95.
(6) For woodstoves, prefabricated fireplaces, masonry fireplaces, gas
fireplaces, or alternate heating devices and components and outdoor
burning devices the fee shall be computed at $50 per $1,000 construction
cost, provided that the minimum fee shall be $110.
(a)
The fee for each incinerator shall be $250.
(b)
The fee for each crematorium shall be $325.
(7) Demolition, abandonment or removal of an aboveground fuel oil tank,
underground fuel oil tank or other type tanks up to 1,000 gallons
shall be $95. Each tanks 1,001 and above the fee shall be $135 each.
(8) The fee for the installation of a solar system shall be $135.
(9) The minimum fee for the issuance of a fire protection subcode permit
that has not been determined in this fee schedule shall be: $95.
F. Elevator subcode. The elevator subcode fees shall be:
(1) The fees for witnessing acceptance tests and performing inspections
shall on new and altered elevator devices shall be as follows:

The basic fees for elevator devices in structures not in Use
Group R-3, R-4, or R-5 or in an exempted R-2 structure shall be as
follows:

(c)
The fee for elevator devices in structures in Use Group R-3,
R-4, or R-5, or otherwise exempt devices in R-2 structures, shall
be $247. Except fees for dumbwaiters, stairway chairlifts, and inclined
and vertical wheelchair lifts shall be $96. This fee shall be waived
when signed statements and supportive inspection and acceptance test
reports are filed by an approved qualified agent or agency in accordance
with N.J.A.C. 5:23-2.19 and 5:23-2.20.

The fee for performing inspection of minor work shall be $76.
(d)
The fee for witnessing acceptance test of, and performing inspections
of, alterations shall be $96.
(2) The fees for routine and period tests and inspections for elevator
devices in structures other than Use Group R-3 or R-4, R-5 or otherwise
exempt devices in R-2 structures, shall be as follows:

The fee for the one-year periodic inspection and witnessing
of tests of elevator devices, which shall include a six-month routine
inspection, shall be:

(3) The fee for any reinspection of an elevator device shall be set at
$203 and shall be billed separately from the above fees upon the issuance
of a notice of violation necessitating a reinspection.
G. Plan review fees.
(1) The fee for plan review shall be 10% of the amount to be charged
for the construction permit. Plan review fees shall be paid at the
time of granting the permit.
(2) The fee for plan review for prototype plans released shall be 10%
of the amount to be charged for a construction permit.
(3) The fee for review of any amendment or changes to a plan that has
already been approved shall be $75 per hour or part thereof per subcode
having assigned plan review responsibility for review of an amendment
or charge to a plan that has already been released. This fee may be
waived at the discretion of the Construction Official in the event
the work and review is of a minor nature.
H. Certificate fees.
(1) The fee for a certificate of occupancy shall be 15% of the new construction
permit fee. The minimum fee shall be $75.
(2) The fee for a certificate of continued occupancy granted pursuant
to a change of use shall be $95 for each technical subcode section.
All commercial property with a change of tenant shall be $95 for each
technical subcode section.
(3) The fee for the first issuance and the renewal of a temporary certificate
of occupancy shall be $95. There shall be no fee for the first issuance
of the temporary certificate of occupancy provide that the certificate
of occupancy fee is paid at that time.
I. The fee for an application for a variation shall be $145.
J. Special inspections.
(1) The fee for special inspections other than during business hours
shall be $150 per hour with a three-hour minimum.
K. Electronic permit surcharge fee.
(1) The electronic permit surcharge fee shall be in the amount of $1
per $1,000 of value of construction per N.J.A.C. 5:23-4.22.

A. All fees paid to the Township pursuant to this chapter
are nonrefundable except as otherwise specifically set forth in the
regulations of the New Jersey Uniform Construction Code. All fees
shall be paid by cash, check, money order or other approved method
payable to Manalapan Township Construction Code Department.
B. In the case of discontinuance of a building project,
the volume of the work actually completed shall be computed. Any excess
for the uncompleted work shall be returned to the permit holder, except
that all penalties that may have been imposed on the permit holder
under the requirements of the regulation shall first be collected.
Plan review fees are not refundable.
The Construction Official shall, with the advice
of the subcode officials, prepare and submit to the Township Committee,
not less than annually, a report recommending a fee schedule based
on the operating expenses of the code enforcing agency and any other
expenses of the municipality fairly attributable to the enforcement
of the State Uniform Construction Code Act.

In order to provide for the training, certification and technical
support programs required by the Uniform Construction Code Act and
the Regulations, the enforcing agency shall collect, in addition to the
fees specified above, a surcharge fee of $0.00371 per cubic foot of
volume of new building and additions, and for all other construction
a fee of $1.90 per $1,000 value of construction. Said surcharge fee
shall be remitted to the Division of Codes and Standards, Department
of Community Affairs, on a quarterly basis.

A. No state or county agencies shall be required to pay
any municipal fee or charge in order to secure a construction permit
for the erection or alteration of any public buildings or part thereof.
B. The Township of Manalapan shall not be charged any
fees pursuant to this section for construction contracted for or conducted
by the Township within its boundaries when the Township itself is
the enforcing agency.
C. The within schedule of fees for inspections and permits
shall be waived for any religious organization or institution organized
pursuant to the New Jersey Nonprofit Corporations Act.
D. No person shall be charged any fees pursuant to this
section for construction, reconstruction, alteration or improvement
designed and undertaken solely to promote accessibility by disabled
persons to any existing private structure or any of the facilities
contained therein.

E. No person who is deemed disabled, nor a parent or
sibling of such a disabled person, shall be required to pay any municipal
fee or charge in order to secure a construction permit for any construction,
alteration or improvement that promotes accessibility to the living
unit of the disabled person.

F. For purposes of this section, a "disabled person"
shall be defined as a person who has the total and permanent inability
to engage in any substantial gainful activity by reason of any medically
determinable physical or mental impairment, including blindness, and
shall include, but not be limited to, any resident of this state who
is disabled pursuant to the federal Social Security Act (42 U.S.C.
§ 416), or the federal Railroad Retirement Act of 1974 (45
U.S.C. § 231 et seq.), or is rated as having a 60% disability
or higher pursuant to any federal law administered by the United States
Veterans' Act. For purposes of this subsection, "blindness" means
central visual acuity of 20/200 or less in the better eye with the
use of a correcting lens. An eye which is accompanied by a limitation
in the fields of vision such that the widest diameter of the visual
field subtends an angle no greater than 20° shall be considered
as having a central visual acuity of 20/200 or less. In addition to
the foregoing, a disabled person shall include any individual meeting
any definition set forth by any amendment to N.J.S.A. 52:27D-126e,
under the authority of which this subsection is enacted.

G. Any veteran
of the armed services who has been determined by the Department of
Veterans Affairs to have a service connected disability of 100% shall
be reimbursed by the Township for up to $500 per calendar year for
any municipal fee or charge paid to secure a construction permit for
any construction, alteration or improvement to the veteran’s
principal residence.
