A. 
Unless another penalty is expressly provided by this title, a person convicted of violating a provision of this title shall be punished by a fine of not more than $500.00.

Notwithstanding subsection A, fines stated as an amount per mile over a designated speed limit established under chapter 9.26 are calculated according to the fine schedule and not subject to the maximum fine amount in this section.

E. 
Any minor convicted under the following sections shall be punished by a fine of not more than $1,500 and community work service of not more than 80 hours, as may be prescribed in the section defining the offense:
1. 
Chapter 9.28 (Serious Traffic Offenses): Sections 9.28.060, 9.28.070, and 9.28.080.
F. 
No provision of this title is intended to affect the authority of the court under state law to revoke, suspend or limit the operator's license of a person who has been convicted of violating a provision of this title.
G. 
In sentencing any person convicted of violating any offense under this title for which the sentence may include a period of imprisonment under subsection C of this section, the court shall also have the power to suspend, revoke or limit that person's driver's license or privilege to drive. For the first conviction of a particular offense within a five-year period, the court may suspend, revoke or limit the driver's license for no more than one year. For a second or subsequent conviction of a similar offense within five years, the license may be suspended, revoked or limited for no more than three years.
H. 
A person who violates a provision of chapter 9.30, 9.32 or 9.34 shall be subject to a civil penalty established pursuant to section 9.30.280.
I. 
In addition to any other remedy or penalty provided by this section, any person who violates any provision of chapter 9.46 shall be subject to a civil penalty of not less than $50.00 and not more than $1,000.00 for each offense, or injunctive relief to restrain the person from continuing the violation or threat of violation, or both injunctive relief and civil penalty. Upon application for injunctive relief and a finding that a person is violating or is threatening to violate any provision of chapter 9.46, the superior court of the state shall grant injunctive relief to restrain the violation.

Editor's note — This ordinance provided that section 2 of this ordinance is effective retroactively to the effective date of AO 2011-113(S), December 22, 2011. These sections clarify the intention of that ordinance to have the penalties for a violation of AMC § 9.28.030B be consistent with state law: a $500.00 fine correctable with presenting proof of insurance which results in dismissal. It also provided that section 5 of this ordinance shall become effective immediately upon its passage and approval by the assembly, 2-14-2012.
A. 
The municipality shall provide books to include traffic citation forms for notifying alleged violators where and when to appear in answer to charges of violating traffic ordinances. The books shall include serially numbered sets of citations, in quadruplicate for moving violations and in duplicate for nonmoving violations, in the form prescribed and approved jointly by the presiding judge and the chief of police.
B. 
The municipality shall issue such books to the chief of police and a duly authorized agent and shall maintain a record of any book so issued and shall require a written report of every such book.
C. 
The chief of police or other officer designated by the municipal manager shall be responsible for the issuance of such books to individual members of the police department. The chief of police or such other officer designated by the municipal manager shall require a written receipt for every book so issued and shall maintain a record of every such book.

Except when authorized or directed to immediately take a person before a district court judge for the violation of any traffic laws, a police officer who cites a person for such violation and does not take such person into custody under arrest shall take the name, address and operator's license number of the person, and registered number of the motor vehicle involved and such other pertinent information as may be necessary, and shall issue to the person in writing on a form provided by the municipality a traffic citation containing a notice to answer the charges against the person in the district court at a date and time provided by the traffic violations bureau. The officer, upon personally serving a copy of the citation for a nonjailable offense upon the alleged violator, shall release such person from custody.

Police officers are authorized to issue tickets and endorse thereon the word "void" in exceptional cases where in their opinion the best interests of justice are served. This privilege shall be scrupulously granted and only for such vehicle mechanical defect violations where there is no deliberate, continued or flagrant violation, and where there are appearances which indicate that the violation might be unavoidable.

A. 
Every police officer, upon issuing a traffic citation to an alleged violator of any provision of any municipal traffic ordinance, shall deposit the original of the nonmoving citation and the original and two duplicate copies of the moving citation with a designated supervisor, who shall cause the citation to be properly filed.
B. 
If the citation charges an offense for which a scheduled fine has been established, the citation shall be deposited with the designated administrator of the municipality and subject to disposition with payment of a fine to the administrator in lieu of a court appearance or as otherwise prescribed. If the citation requires a mandatory court appearance, or if a defendant enters a plea of not guilty, the original citation shall be immediately filed with the district court and may be disposed as provided by law. (AS 12.25.210(a) and AMC Section 9.48.130).
C. 
The chief of police shall require the return of each traffic citation and all copies thereof which have been spoiled or upon which any entry has been made and has not been issued to an alleged violator.
D. 
The chief of police shall also maintain or cause to be maintained a record of all warrants issued by the district court for the municipality on traffic violation charges and which are delivered to the police department for service and of the final disposition of all such warrants.
E. 
It is unlawful and official misconduct for any member of the police department, or other officer or public employee, to dispose of, alter or deface a traffic citation or any copy thereof, or the records of the issuance or the disposition of any traffic citation, complaint or warrant in any manner other than as required in this chapter.

If the form of the citation provided under section 9.48.020 includes information and is sworn to as required in respect to a complaint charging commission of the offenses alleged in the citation when filed in the court having jurisdiction, it shall be deemed to be a lawful complaint for the purpose of prosecution under this chapter.

A. 
It is unlawful for any person to fail to obey a written traffic citation, received from a sworn police officer, requiring a person to either:
1. 
Appear in court; or
2. 
Submit payment for; or
3. 
Correct an alleged violation within the time allowed, regardless of the disposition of the charge for which such citation was originally issued.
B. 
A violation under this section may be resolved through:
1. 
The administrative hearing procedures in title 14, applying the scheduled penalty set forth in section 14.60.030; or
2. 
The courts, applying the scheduled penalty set forth in section 9.48.130.

If any person fails to comply with a traffic citation given to such person or fails to make appearance pursuant to a summons directing an appearance in the district court, or if any person fails or refuses to deposit bail as required and within the time permitted by ordinance, a warrant for the person's arrest shall be issued. Following the issuance of a warrant under this section, the chief of police or designee shall, if the basis therefor is apparent, initiate a complaint under section 9.48.080 based upon the failure of the alleged violator to resolve the citation.

When a person pleads guilty or nolo contendere to, or is convicted of, a motor vehicle or traffic offense and a corresponding fine amount is established in the Schedule of Traffic Offense Fines in section 9.48.130, the sentence imposed shall be the scheduled fine and any applicable surcharges. Reduction of the scheduled fine amount is prohibited pursuant to Alaska Rules of Minor Offense Procedure 10(a).

In accordance with AS 28.05.151, a citation issued for violation of any of the following sections of this title shall be subject to disposition with payment of a fine in lieu of a court appearance or as otherwise prescribed. Violations committed within a highway work zone or a traffic safety corridor shall be subject to double the fine amount indicated. Pursuant to AS 28.05.151(e), an offense listed on this schedule may not be disposed of without court appearance if the offense is in connection with a motor vehicle crash that results in the death of a person. Notwithstanding any other provision of this Code, fines stated as an amount per mile over a designated speed limit established under chapter 9.26 are calculated according to the fine schedule and not subject to the maximum fine amount in this section 9.48.010A.

Categories of traffic offenses:
Corr. = A correctable/dismissible offense. A citation for one of these offenses may be dismissed (or voided) if proof of correction is presented to an inspection official. If the required repair is not made and shown to an inspecting officer within the specified time, the citation converts to a set fine in the amount indicated and must be resolved under section 9.48.030. A citation for violating section 9.28.030B for not having proof of insurance or other security shall be dismissed if the person cited produces such proof in accordance with that section. A citation for violating section 9.36.045D for not having proof of a medical prescription or medical certification shall be dismissed if the person cited produces such proof in accordance with that subsection.
