Notwithstanding anything to the contrary contained in Article 15-A of
the former Village Law of the State of New York (adopted by Chapter 650, Laws
of 1927) or contained in any former referendum or local law, ordinance or
resolution of the Board of Trustees of the Village of Ellenville, the Village
Manager of the Village of Ellenville shall only have those duties, powers
and rights set forth below.
The administrative and executive powers (except as provided for by §
27-9 herein) of the Village of Ellenville, including the power of appointment of all employees (subject to Board approval) except the Village Clerk, Deputy Clerk, Treasurer, Building Inspector, Community Development Director, Assistant Building Inspector, Village Attorney, Acting Village Justice and members of the Police Department, are vested in a person to be known as the "Village Manager," who
shall be appointed by the Board of Trustees and hold office during the pleasure
of such Board. Such person shall receive such compensation as shall be fixed
by the Board of Trustees.
A. At the time of his/her appointment, he/she need not be
a resident of the Village of Ellenville or the state, but shall become a resident
of the Village of Ellenville within 90 days after appointment and so remain
during his/her tenure of office.
B. Such person shall be chosen by the Board of Trustees
without regard to such person's sex, political beliefs, race, religion
or national origin and solely upon the basis of such person's executive
and administrative ability.
C. The Village Manager may be bonded as the Board of Trustees
may deem necessary.
No member of the Board of Trustees, including the Mayor, shall be appointed
as Village Manager during the term for which he/she shall have been elected.
During the absence or disability of the Village Manager, the Board of
Trustees may designate any properly qualified person to perform the duties
of the office during such absence or disability, such person to be known as
the "Acting Village Manager."
The Village Manager shall report to and be under the supervision of
the Mayor and Board of Trustees.
The powers and duties of the Village Manager shall, except as provided
hereinafter, include the following:
A. See that within the Village of Ellenville the laws of
the state and rules, regulations. ordinances, local laws and codes of the
Village of Ellenville are faithfully executed and administered efficiently
and fairly.
B. Oversee and coordinate the activities of all Village
of Ellenville departments, in accordance with the policies of the Board of
Trustees.
C. See that all inquiries by residents of the Village of
Ellenville or other interested persons are referred to the appropriate Village
of Ellenville official or department head for investigation or response.
D. Attend meetings of the Board of Trustees.
E. Act as purchasing agent for the Village of Ellenville
and its separate boards and commissions, supervise the preparation of necessary
documents required for obtaining bids on materials, equipment or capital projects
as authorized by the Board of Trustees and oversee the purchasing procedures
and letting of contracts authorized by the Board of Trustees.
F. Supervise and control all expenditures, encumbrances
and disbursements to ensure that budget appropriations are not exceeded and
audit all claims against the Village of Ellenville.
G. Act as Budget Officer of the Village of Ellenville; prepare
and submit to the Board of Trustees a tentative budget for the next fiscal
year.
H. From time to time, make recommendations to the Board
of Trustees as to measures or programs which he/she believes will improve
the efficiency or economy of the Village of Ellenville government.
I. Make reports to the Board of Trustees, from time to time,
upon the affairs of the Village of Ellenville and keep the Board of Trustees
fully advised of the financial condition of the Village of Ellenville and
its future financial needs.
J. Such other duties and responsibilities as may, from time
to time, be delegated by the Mayor or authorized by the Board of Trustees.
Such village employees as the Board of Trustees shall determine are
necessary for the proper administration of the village, except the Village
Clerk, Deputy Village Clerk, Treasurer, Village Attorney, Building Inspector,
Assistant Building Inspector, Community Development Director, Acting Village
Justice and members of the Police Department, shall be appointed and may be
removed by the Village Manager, subject to the approval of the Board of Trustees
at the next meeting thereof following any such appointment or removal.
The Village Manager shall keep the Mayor and the appropriate Trustee
assigned as liaison to a department currently informed as to matters affecting
the efficient functioning of the department to which the Trustee is so assigned.
Nothing herein contained shall be deemed or construed as abolishing,
transferring or curtailing any powers or duties of the Board of Trustees or
of the Mayor, Deputy Mayor, Treasurer, Clerk or Attorney or Village or Acting
Village Justice, as prescribed by the Village Law of the State of
New York or other applicable laws of the state.
This chapter will take effect immediately upon the filing of same with
the Secretary of State, which said filing will not take place until 30 days
after its adoption by the Board of Trustees, unless a referendum is required
to be held by the filing of a petition as set forth in Article 9 of the Village
Law of the State of New York, in which event it will only be filed if and
when it is approved by the electorate of the Village of Ellenville.
