Prior to August 2, 1995, § 7-738(2)
of the Village Law empowered the Board of Trustees to grant cluster
development authorization to the Planning Board by resolution specifying
the lands to which cluster development may be applicable. The courts
interpreted such language to mean that such authorization may be granted
for a particular parcel of land. As amended by Chapter 417 of the
Laws of 1995, effective August 2, 1995, § 7-738(2)(a) of
the Village Law empowers the Board of Trustees to grant cluster development
authorization to the Planning Board by local law specifying the zoning
districts in which cluster development may be applicable. It is not
clear from such language whether such authorization may still be granted
for a particular parcel of land. If and to the extent that § 7-738(2)(a)
of the Village Law does not empower the Board of Trustees to grant
cluster development authorization to the Planning Board for a particular
parcel of land, this local law is intended to amend § 7-738(2)(a)
of the Village Law in its application to the Village of Southampton
so that such authorization may be granted for a particular parcel
of land. Section 7-738(2)(a) of the Village Law is hereby amended
in its application to the Village of Southampton by adding the following
provision at the end thereof, to wit: Such local law may specify the
lands to which cluster development may be applicable, may authorize
the Planning Board to approve a cluster development for a particular
parcel of land, and may provide that such authorization shall be limited
to the particular parcel of land therein specified.

The Planning Board was established by the Village Board on June
3, 1927. The organization and general procedures of the Planning Board
shall be in accordance with the provisions of § 7-718 of
the New York Village Law.
The Planning Board shall consist of five members appointed by
the Mayor with the approval of the Village Board. The terms of office
shall be in accordance with the provisions of § 7-718 of
the New York Village Law.
All members of the Planning Board, including alternate members,
shall be required to meet the training and continuing education requirements
as established by law and the Village Board.
For the purposes of substituting for a member of the Planning
Board in the event that such member is unable to participate because
of a conflict of interest or is otherwise unavailable, the Mayor may
appoint one or more alternate members subject to the approval of the
Village Board, with any such appointment for a term of one year from
the date of appointment. Any designation of an alternate member in
replacement of a member on a particular case shall be made by the
Chairperson of the Planning Board and shall be entered in the minutes.
