There is hereby established a Housing Commission
for the Village of Southampton, which shall be advisory to the Village
Board, the Planning Board, the Zoning Board of Appeals and the Architectural
Board of Review. The Commission shall also be advisory to the Building
Inspector and Building Department.
Appointment of members to the Commission shall
be made by the Mayor, with the approval of a majority of the Village
Board of Trustees.
If a vacancy shall occur otherwise than by expiration
of a member's term, it shall be filled by an interim appointment for
the remainder of the former member's unexpired term.
The Commission shall adopt rules of procedure
as may be necessary to the proper exercise of its responsibilities
with respect to the foregoing purposes of its establishment.
Each decision of the Commission shall be by
resolution. It shall be approved by a majority of the Commission.
Notwithstanding the foregoing, in the case of
applications for a renewal of a special exception use relating to
accessory apartments, where the recommendation of the Commission shall
be requested or required, such requests shall be reviewed by a committee
of one member of the Commission, designated by the Chairman, to determine
whether or not consideration by the full Commission shall be appropriate.
Except for extraordinary circumstances, the report and recommendation
of the Commission shall be given by such committee of one member.
In making a recommendation for referral of such a case to the full
Commission, such committee of one member shall set forth in such recommendation
the reason either for or against referral of the request to the full
Commission in addition to the recommendation by such member. The report
and recommendation of the Commission shall set forth its findings
and conclusions.
In the event that the committee or the full
Commission shall fail to issue a recommendation with regard to an
application within 30 days after the same shall have been referred
to the Commission, the recommendation of the Commission shall be deemed
to have been a recommendation in favor of the subject application.
Such thirty-day period may be extended for good cause by a majority
of the Commission with the consent of the applicant.
No extension of a special exception use relating
to an accessory apartment shall be granted by the Zoning Board of
Appeals unless the same shall have first been referred to the Housing
Commission.
