For the purpose of providing for the future growth and development of the Town and affording adequate facilities for the housing, transportation, distribution, comfort, convenience, safety, health and welfare of its population, the Planning Board is empowered and authorized to approve preliminary and final plats of subdivision showing lots, blocks or sites, with or without streets or highways, within that part of the Town outside the limits of the Village of Baldwinsville.
When used in this chapter, the following terms shall have the following respective meanings, except where the context shows otherwise:
CLUSTER DEVELOPMENT
As a condition of approval of a subdivision plat or plats pursuant to this article, the modification of the applicable zoning ordinance or local law to provide an alternative permitted method of the development of such plat or plats to allow all of the development which could occur on a particular parcel of land to be developed on a portion of said parcel. In no case shall the number of building plots or dwelling units exceed the number which could be permitted, in the Planning Board's judgment, if the land were subdivided into lots conforming to the minimum lot size and density requirements of the applicable zoning ordinance or local law.
CONDITIONAL APPROVAL OF A FINAL PLAT
Approval by a Planning Board of a final plat subject to conditions set forth by the Planning Board in a resolution conditionally approving such plat. Such conditional approval does not qualify a final plat for recording nor authorize issuance of any building permits prior to the signing of the plat by a duly authorized officer of the Planning Board and recording of the plat in the office of the County Clerk.
FINAL PLAT
A drawing prepared in a manner prescribed by Town regulation that shows a proposed subdivision, containing in such additional detail as shall be provided by Town regulation all information required to be shown on a preliminary plat and the modifications, if any, required by the Planning Board at the time of approval of the preliminary plat if such preliminary plat has been so approved.
IMPROVEMENTS
Those physical additions and changes to the land to be subdivided that may be necessary to produce usable and desired lots, including but not limited to grading, paving, curbing, fire hydrants, water mains, sidewalks, crosswalks, street shade trees, street signs, street lighting standards and monuments.
MAJOR SUBDIVISION
Any subdivision not classified as a minor subdivision.
MINOR SUBDIVISION
Any subdivision, or a subdivision and resubdivision or resubdivisions within a ten-year period, dividing a parcel of land into three or fewer lots or sub parcels on existing public streets required by the zoning regulations and requiring no new streets, nor the creation or extension of improvement districts for the supply of water, sewer or drainage facilities, and having no substantial adverse affect upon, access to, use or development of the remainder of the parcel or adjoining parcels.
PRELIMINARY PLAT
A drawing prepared in a manner prescribed by Town regulation showing the layout of a proposed subdivision, including, but not restricted to, road and lot layout and approximate dimensions, key plan, topography and drainage and all proposed facilities unsized, including preliminary plans and profiles, at suitable scale and in such detail as local regulation may require.
PRELIMINARY PLAT APPROVAL
The approval of the layout of a proposed subdivision as set forth in a preliminary plat but subject to the approval of the plat in final form in accordance with the provisions of this section.
SUBDIVISION
The division of any parcel of land into a number of lots, blocks, sites, parcels or subparcels, with or without streets or highways, for the purpose of sale, transfer of ownership or development. The term "subdivision" shall include any alteration of lot lines or sites shown on a plat previously approved and filed in the office of the County Clerk.
