GENERAL REFERENCES
Salaries and compensation — See Ch. 31.
The following does hereby constitute the administrative rules and regulations
governing the employment of personnel by the Incorporated Village of New Hyde
Park.
As used in this chapter, the following terms shall have the meanings
indicated:
Any person receiving compensation from the village on an hourly or
weekly basis.
All regular employees shall be hired on one of the following bases:
Temporary or provisional employees shall be employed on a weekly or
hourly basis, as the Board of Trustees shall order and direct.
All regular employees shall be entitled to those holidays which are
officially recognized by the State of New York as legal holidays and shall
receive their usual pay for those holidays.
Regular employees shall be entitled to the following vacation periods,
with pay:
A.
In the event of sickness, injury or disability occurring
to an employee which arises out of and in the course of his employment, such
employee shall be entitled to his regular wages for a period of two weeks,
less any amount which may be paid to him under the workers' compensation
laws of the State of New York for that period.
B.
In the event of sickness, injury or disability not arising out of and in the course of his employment, such employee shall be entitled to a total of one workweek sick leave per annum, which leave shall not be cumulative. The Board of Trustees may, in its discretion, allow such leave only upon a physician's certification as to the sickness, injury or disability, but in any event, such sickness, injury or disability shall be certified by the employee's immediate superior at the same time as such supervisor certifies the weekly payroll as set forth in § 25-9 below.
The Village Board may, in its discretion and for good cause shown, grant
an employee temporary leave with or without pay, as it shall determine on
the facts of the particular case. Nothing contained herein shall alter or
prejudice any rights an employee may have under any statute of the State of
New York.
It shall be the duty of the immediate supervisor of all employees to
keep and maintain a record of each employee under his supervision, and such
supervisor shall certify to the Village Clerk on a weekly basis the number
of hours worked by each such employee.
A.
No employee shall be entitled to any overtime compensation,
and no overtime compensation shall be paid to any employee, unless such overtime
has previously been authorized by the Board of Trustees.
B.
If, in the opinion of the Mayor, it becomes necessary
to use the services or labor of a village employee in an emergency or similar
circumstance, including but not limited to snow removal and street repairs,
and such labor or services is found to be necessary outside the regular hours
of employment, the Mayor is authorized to direct the performance of such emergency
service or labor as may be necessary, and such service or labor shall be deemed
as overtime, and the person or persons performing such service or labor shall
be entitled to overtime compensation therefor.
All employees whose period of employment is otherwise fixed by law shall
be discharged only for cause and upon prior notice and opportunity to be heard.
All other periods of employment shall be as fixed by the Board of Trustees
at the annual meeting.
These rules and regulations shall remain in force and effect until such
time as they are amended or modified by resolution of the Board of Trustees.
