A. 
There shall be constructed, according to the grade established by the Village Engineer, with each construction of a building, residential or commercial, exclusive of private garages and outbuildings, sidewalks and curbs according to the specifications set forth in this section:
(1) 
Concrete mixture. The concrete shall be mixed and finished in strict accordance to specifications of the Department of Public Works of the County of Nassau, and the aggregate shall be as defined in their specifications. Expansion joints must be placed where directed by the Village Engineer.
(2) 
Pouring of concrete. No concrete is to be poured or placed except under the supervision of the Village Engineer or his representative.
(3) 
Curbs. Curbs shall be 18 inches in depth with six inches extending above the gutter line, five inches in width at the top and six inches at the gutter line and at the bottom. The face of the curb shall be battered one inch for its full exposed height of six inches, and the top shall be rounded one inch. The curb shall be constructed of concrete composed of a one-to-two-to-four mix. No more than one curb cut per residential property shall be permitted in a residential zone. Any person seeking variance of this section shall make application to the Zoning Board of Appeals.

(4) 
Sidewalks. Sidewalks shall be four inches thick, four feet wide, constructed of one course concrete with a one-to-two-to-four mix, except that, with respect to each construction of a commercial building hereinafter constructed, there shall be constructed on each side of such building which faces on a public street or highway in the village, sidewalks from curbs to lot lines. A premolded asphalt-type expansion joint 3/4 inch wide and thickness equal to the sidewalk or driveway shall be placed between the curb and sidewalk continuously throughout the length of the sidewalk. Where the sidewalk is laid in driveway entrances, it shall be six inches thick.
B. 
Driveway aprons shall be six inches thick, 13 feet wide at the face of the curb and 10 feet under at the property line, with a step in the face of the curb of 1 1/2 inches constructed of a one-to-two-to-four concrete mix.
C. 
Six-by-six-by-ten-gauge wire mesh shall be placed on all sidewalks and aprons, with two inches cover from the top, prior to pouring concrete.
D. 
No sidewalk shall be constructed until the owner and/or contractor has obtained all the necessary permits. No concrete may be poured unless and until the premises have been inspected by the Building Department. In the case where sidewalk construction has been completed without a Village inspection, the homeowner and/or the contractor must file a certification form with the Building Department stating that the sidewalk has been constructed according to the specifications outlined in § 165-36A, and such form shall be accompanied by a fee. All fees shall be prescribed under the schedule set forth in § A198-1 of the Village Code, either as currently adopted or hereafter amended by resolution or order of the Board of Trustees.

No oversight or dereliction of duty on the part of the Building Inspector shall legalize the construction or alteration of a structure that does not conform to the provisions of § 165-36.
Upon the recommendation of the Building Inspector and upon the approval of a majority of the members of the Village Board of Trustees, any provisions or requirements of § 165-36 may be waived. The Village Board of Trustees, at the time of such approval, may impose substitutional or additional rules, terms or conditions to be met in order to carry out the intent and purpose of such section, and a violation of any such terms or conditions shall constitute a violation of such section and be subject to the penalty provided for in § 1-20. A waiver of any provision or requirement of such section under the terms of this section shall not be deemed to be a waiver of any other requirement or provision.

With each application for a permit for the construction of a building, commercial or residential, there shall be paid to the Village Clerk an additional fee of $35 for the first 100 feet of street frontage or any part thereof and $1.50 additional for every 10 feet over the first 100 feet, which shall cover the engineering fee for establishing the grade of the sidewalk and curb and inspection of same by the Village Engineer. No sidewalk and/or curb shall be replaced or installed at any time until the above-mentioned fees have been paid, a permit secured, the grades established by the Village Engineer and staked out by the party doing the work.
