It shall be lawful for any authorized organization, as defined in § 476
of Article 14-H of the General Municipal Law, upon obtaining a license, to
conduct the game of bingo within the territorial limits of the Town of Marbletown,
subject to the provisions of this chapter, Article 14-H of the General Municipal
Law and Article 19-B of the Executive Law and the following restrictions.
Games of bingo shall be conducted in accordance with the provisions
of General Municipal Law § 479.
The unauthorized conduct of a bingo game and any willful violation of
any provisions of any such local law or ordinance shall constitute and be
punishable as a misdemeanor, punishable by a maximum fine of $1,000, one year's
imprisonment, or both.
This chapter is enacted pursuant to Article 9-A of the General Municipal
Law of the State of New York and shall be known as the "Games of Chance Ordinance
of the Town of Marbletown."
The words and terms used in this chapter shall have the same meaning
as these words and terms are defined and used in Article 9-A of the General
Municipal Law, unless otherwise provided herein or the context plainly requires
a different meaning. Any reference herein or in Article 9-A of the General
Municipal Law to "Town" shall mean the Town of Marbletown. "Officer" shall
mean the chief law enforcement officer of the Town of Marbletown.
Games of chance may be conducted in the Town by an authorized organization,
after obtaining a license therefor, in accordance with the provisions, requirements
and limitations of Article 9-A of the General Municipal Law, the rules and
regulations of the New York State Racing and Wagering Board and this chapter.
The conduct of games of chance on Sunday is authorized, except as otherwise
provided in Article 9-A of the General Municipal Law.
The powers and duties set forth in Subdivision 1 of § 194
of the General Municipal Law shall be exercised by the Sheriff of Ulster County,
and the fees provided by Subdivision 2 of § 195-f of the General
Municipal Law shall be remitted to the Treasurer of Ulster County.
