The key box shall be of a type approved by the
Fire Marshal and any applicable first responders. The structure owner
shall not be able to obtain a key to open the key box.
The key box shall be mounted on the structure
entrance at a height of between four feet and six feet and within
three feet of the direct access door or such other location approved
by the Fire Marshal or his or her designee. Flush-mounted or surface-recessed
key box installations will be permitted, provided that the key box
is clearly marked. Once the key box is installed, the owner of the
structure shall contact the Fire Marshal or his or her designee during
regular office hours to arrange for the owner of the structure to
be contacted and visited by the Fire Marshal or his or her designee
to inspect the key box and install the access keys.
The key boxes shall contain the following:
A. Keys or access cards to all locked points of egress,
whether on the interior or exterior of such structure.
B. Keys or access cards to mechanical equipment rooms.
C. Keys or access cards to electrical rooms.
D. Keys or access cards to elevator controls.
E. Keys or access cards to other areas, as directed by
the Fire Marshal.
The owner or tenant of a building containing hazardous materials shall, at all times, keep the following items in the key box, in addition to those set forth in §
271-4 above:
A. Copies of material safety data sheets for any hazardous
materials located within the building.
B. A floor plan for each floor of such building, showing
the layout of each floor, locations of points of egress from such
floor to the exterior of the building and any other information required
by the Fire Marshal.
The owner of a building or structure having
a key box shall provide a list of contact persons, indicating names,
home addresses and home telephone numbers, to the Fire Marshal or
his or her designee. The owner of such building or structure shall,
immediately upon any change with respect thereto, furnish the Fire
Marshal such information with respect to such change.
Any person, firm or corporation which shall
violate any provisions of this chapter or any regulations adopted
hereunder shall, upon summary conviction thereof, be sentenced to
pay a fine of not more than $1,000 and not less than $25 and, in default
of payment thereof, to imprisonment for not more than 30 days.
