The Board of Supervisors of Upper Hanover Township
hereby establishes the following rules and regulations which shall
be applicable to Camelot Park, Centennial Park and Macoby Run Park.
As used in this chapter, the following terms
shall have the meanings indicated:
PLAYGROUND
Township park, park areas or parklands where any piece of
playground equipment is located and any surrounding areas up to and
including 50 feet around such structures and Township park and recreation
areas that are enclosed by any type of fencing.
PLAYING FIELD
Township park, park areas or parklands that are the actual
required dimensions for active recreation programs, i.e., baseball,
basketball, tennis, football, volleyball, softball, soccer, designated
jogging or walking areas or other recreational programs under the
jurisdiction of the Township and any area within 50 feet of those
areas.
The parks of Upper Hanover Township are open
throughout the year to all Township residents and their guests when
accompanied by Township residents. Park areas are open between 7:00
a.m. and dusk. Only authorized persons may be in a park between dusk
and 7:00 a.m.
No persons shall damage, injure, deface, remove,
dig, cut or change any of the trees, plants, shrubs, turf, building,
structures or fixtures therein or any property of the Township located
within such parks.
No person shall remove any Township property
from Township parks.
No conduct shall be permitted within any park
which causes annoyance to any other person, nor shall obscene language
be used, nor shall conduct of an immoral or indecent nature be permitted.
No person or organized group of persons shall
hold any meeting or gathering assembled through advertisement or public
notice or any gathering otherwise assembled and composed of more than
five persons within the limits of any of the parklands without first
having made an application to the Township Manager for a permit therefor.
Such permit shall indicate the location where such gathering or meeting
shall be held, and such gathering shall not be held in any other location
within any of the park areas of the Township. The application for
such permit shall be in the name of the person or organized group
of persons who shall be responsible for seeing that all refuse left
by the group shall be placed in proper containers before leaving the
parklands.
A. Any person or group to whom a permit is issued must
provide proof of insurance coverage for liability for personal injuries
and property damages in the kinds and amounts established from time
to time by resolution of the Board of Supervisors.
B. Any person or group to whom a permit is issued shall
be liable for any losses, property damage or personal injuries sustained
to any person or property by reason of the conduct, acts or failure
to act of the person or group obtaining the permit, its members, agents,
employees or invitees.
C. Any person or group to whom a permit is issued shall
indemnify and hold harmless the Township, its officers, agents and
employees from and against all claims, damages, losses and expenses,
including court costs and attorney's fees, arising out of or resulting
from the activities being conducted upon Township park, park areas
or parklands, including all losses resulting from any injury to property
or persons occasioned by neglect, an accident or any other reason
whatsoever during such activities.
No person shall sell or set up any booth, table
or stand for the sale of any article or service within the limits
of any of the park areas without the consent of the Township Parks
and Recreation Department, which shall have authority to refuse such
consent in any instance.
No person shall dispose of any waste or garbage
in the parklands except in a receptacle designated for the respective
purposes, and all persons using such park areas shall dispose of all
waste and garbage left in proper receptacle. No person shall dispose
of any waste or garbage within a Township park when such waste or
garbage is generated outside of park areas.
No persons shall injure, deface or destroy any
notice, rule or regulation posted any place within the park area,
nor shall any person post any place within such parklands any notice
or placard other than official signs and notices posted by and under
the authority of the Park and Recreation Department or the Township.
No persons shall bring any alcoholic beverage
or any illegal drug into any of the park areas either for his own
use or for the use of any other person. No person shall enter the
park in an intoxicated state or otherwise be under the influence of
alcohol or illegal drugs.

No person shall engage in hunting or trapping
within the limits of any Township park. Firecrackers, fireworks, motor-powered
model aircraft, explosives, arrows, slingshots and other similar missile-propelling
instruments are prohibited within the limits of any Township park.
A. Lawful operation. No person shall operate any motor-powered
vehicle within any of the parklands, except to enter or leave, and
then only on the designated driving and parking areas.
B. Prohibited vehicles. No minibikes, motorbikes, go-carts,
all-terrain vehicles, snowmobiles or any other like vehicle propelled
by a gasoline internal-combustion engine or propelled by any other
kind of fuel or battery shall be permitted in the park areas.

C. Parking for washing or repairing prohibited. No person
shall stand or park a motor vehicle upon roadways or parking lots
within a Township park, park area or parkland for the principal purpose
of washing or repairing such motor vehicle, except for repairs necessitated
by an emergency.
D. Patron parking only. No person shall park a motor
vehicle within any Township park, park areas or parklands unless such
person is a patron who is actually using such areas for proper purposes
during the time such motor vehicle is parked therein or thereon.
E. Hours for parking regulated. No person shall park
a motor vehicle in or upon any Township park, park areas or parklands
at any time other than during normal hours or lawful operation of
the Township park, park areas or parklands.

F. Parking in designated areas only. No person shall
park a motor vehicle in or upon any Township park, park areas or parklands
except in designated parking areas.

A. Skateboards are prohibited.
B. Roller blades/skates are permitted.
C. Bicycles are permitted at Camelot Park and Macoby
Run Park but are prohibited at Centennial Park.

No fire shall be made within any park area.
The use of all cooking grills is prohibited. The use of all tobacco
products is prohibited within all Township park areas, including the
use of cigarettes, cigars, pipes, chewing tobacco and other like tobacco
products.
Gambling of any kind is not permitted within
any park area.
A. Pets to be leashed and not to annoy patrons. Pets
must be on a leash, and such pets must not be permitted to annoy any
person or other animal within a park area.

B. Owners to comply with other ordinances. The owner
of a dog or the person having custody or control of such dog shall
be in compliance with all other ordinances and regulations pertaining
to the conduct of such animals and must clean up after their pets.
C. Consent/permission of Director for noncompliance.
The Park and Recreation Director shall have the authority to issue
consent or permission for pets within park areas for educational purposes
or recreational programs where the activities of such pets may not
be in compliance with the provisions of this chapter or other pertinent
provisions of the Code of the Township dealing with animals.
D. Exception for Seeing Eye dogs and dogs for the hearing
impaired. Guide and/or hearing dogs for the blind or deaf or dogs
used to accompany any other physically handicapped person may be permitted
for such use within a park area.
E. Presence on playing fields prohibited. No person being
the owner or person in charge or control of any animal shall allow
such animal or permit such animal upon any playing field or playground
area or within 50 feet of any Township property maintained as a playing
field or playground area, other than for Township recreation program
purposes.
F. Horses prohibited. Horses are prohibited from entering
all Township parks.
No person shall be permitted to carry, whether
concealed or unconcealed, a knife with a blade in excess of three
inches in length, nor may any such implement be allowed within or
to be used within any park area except as such implement may be required
in connection with the preparation and consumption of food.
No person shall be permitted to play or practice
golf within or upon any Township park, park areas or parklands unless
the area is specifically designated for that purpose. Swimming, the
use of flotation devices, boating, pitching horseshoes, and the use
of detectors to engage in finding buried objects are prohibited.
Any person or persons violating any of the provisions
of this chapter shall be subject to a criminal fine not to exceed
$1,000 per violation, plus restitution for damages done, and imprisonment
in the Montgomery County Correctional Facility to the extent allowed
by law for the punishment of summary offenses. Enforcement of any
such violations shall be by action brought before a Magisterial District
Judge in the same manner provided for the enforcement of summary offenses
under the Pennsylvania Rules of Criminal Procedure.
