A. 
As used in this article, the following terms shall have the meanings indicated:
ASHES
The residue from the burning of wood, coal, coke, paper, paper cartons or other combustible materials, including ashes from outdoor incinerators.
GARBAGE
The animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of foods.
PERSON
Any natural person, association, partnership, firm or corporation.
REFUSE
All solid wastes, including garbage, rubbish and ashes, with the exception of body wastes.
RUBBISH
Tin cans, bottles, broken crockery, glass, paper, paper boxes, rags, old shoes, carpets or such other articles as are daily thrown into the waste can or rubbish heap, and in addition thereto, tree trimmings, hedge clippings, grass and weed cuttings.

In this article, the singular shall include the plural and the masculine shall include the feminine and the neuter.
A. 
Preparation of refuse.
(1) 
All garbage, before being placed in refuse containers, shall be drained free from all liquids and shall be wrapped in several thicknesses of paper or placed in a suitable bag or container.
(2) 
All refuse shall be drained of any liquid before being deposited for collection.
(3) 
All cans and bottles which have contained food shall be thoroughly rinsed and drained before depositing for collection.
(4) 
Tree trimmings, hedge clippings, old newspapers and similar materials which cannot be conveniently placed in the aforementioned containers shall be baled, tied, or sacked in compact bundles under three feet in length and placed in a location easily accessible to the collector.
B. 
Refuse containers.
(1) 
Cans, pails or combination of same with lids and/or covers shall not be more than three in number.
(2) 
Refuse receptacles shall be kept as sanitary as possible and shall be thoroughly cleansed by the owner, at least periodically, after collection.
(3) 
Receptacles shall be made of rust-resistant material, be watertight, be provided with a watertight cover and have proper handles.
(4) 
No person shall use a refuse receptacle having a capacity of more than 50 gallons or less than five gallons and such receptacle with contents shall not exceed 50 pounds in weight.
(5) 
All refuse receptacles shall be provided by the owner, tenant or occupant of the premises.
(6) 
It shall be the duty of the refuse collector to handle all containers carefully and to replace the lid on containers after each collection. Failure to comply with such a request will constitute a violation of this article.
(7) 
Wet and/or broken corrugated boxes will be refused.
C. 
Storage of garbage and refuse.
(1) 
No person shall place any garbage or refuse in any street, alley or other public place, or upon any private property, either owned by such person or not, within the limits of Kidder Township, unless same is placed in a proper receptacle for collection. Likewise, no person shall throw or deposit any garbage or refuse in any stream or any other body of water.
(2) 
Any unauthorized accumulation of refuse on any premises is hereby declared to be a nuisance and is prohibited. Failure to remove any existing accumulation of refuse within three days after the effective date of this article shall be deemed a violation of same.
(3) 
A reasonable amount of material, such as scrap lumber and firewood, may be kept on the premises, but it shall be racked and stacked 12 inches above the ground.
A. 
Place of collection. Refuse receptacles, for collection purposes, shall be placed at ground level on the property, not within the right-of-way of a street or alley, and easily accessible from the side of the street or alley from which collection is made.
B. 
Frequency of collection.[1]
(1) 
Refuse shall be collected once weekly from the householders of Kidder Township.
(2) 
If a collection day falls on a legal holiday, refuse shall be collected on the following day.
(3) 
Refuse shall be collected between the hours of 5:00 a.m. and 2:00 p.m.

C. 
Licensing of collectors.
(1) 
No person except an authorized collector shall collect garbage from any other person for conveyance through Kidder Township, nor shall any person except such authorized collector haul any refuse for any other person from any point within Kidder Township to any place or location outside the Township.
(2) 
An authorized collector is one who has been granted a license by the Supervisors of Kidder Township for the specific purpose of collection and disposal of garbage and refuse.
(3) 
The applicable contractor's license fee will be applied to the licensing of collectors, and all licenses shall be issued by the Supervisors of Kidder Township.[2]

(4) 
Failure of licensed collectors to comply with provisions of this article shall result in having said permits revoked.
(5) 
No person shall permit any unlicensed collector to take any garbage or refuse from premises occupied by him.
D. 
Collection vehicles. All collection vehicles utilized shall be constructed of metal, watertight, and shall be securely covered at all times.
Any person who violates or permits a violation of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the township before a District Justice, pay a fine of not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the township in the enforcement of this chapter. No judgment shall be imposed until the date of the determination of the violation by the District Justice. If the defendant neither pays nor timely appeals the judgment, the township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
