This local law shall be known and may be cited as local law amending the local law of the Town of Halfmoon entitled, "Local Law Relating to Zoning for the Town of Halfmoon," providing for the creation of a planned development district to be known as "Planned Development District No. 7."
The Zoning Map is amended so as to create and define the boundaries of a planned development district which shall be designated C-I (Business-Commercial-Industrial Development), all as shown on the map which accompanies and with all explanatory matter thereon, and hereby is made a part of this local law, and it is bounded as described as follows:
ALL THAT TRACT, PIECE OR PARCEL OF LAND situate in the Town of Halfmoon, Saratoga County, New York, lying along the Northeasterly margin of U.S. Route 9 and along the Westerly margin of Plant Road, being more particularly bounded and described as follows:
BEGINNING at a point in the Northeasterly margin of U.S. Route 9, where said road margin is intersected by the division line between lands of Cruickshank on the North and lands now or formerly of Shaffer on the South; and runs thence along said division line in a generally Easterly direction approximately 697 feet to the Southwesterly corner of lands now or formerly of Cardin; thence along said lands of Cardin generally Northerly approximately 109 feet to the Northwesterly corner of said lands of Cardin; thence continuing along said lands of Cardin in a generally Easterly direction approximately 159 feet to a point in the Westerly margin of Plant Road; thence along said road margin in a generally Northerly direction approximately 1099 feet to the Southeasterly corner of lands now or formerly of Martin; thence along said lands of Martin in a generally Westerly direction a distance of approximately 300 feet to the Southwesterly corner of said lands of Martin; thence through lands of Cruickshank in a generally Northwesterly direction approximately 830 feet to a point in the Easterly line of lands of DeVoe, said point lying approximately 485 feet distant in a generally Northerly direction as measured along said Easterly line from the Southeasterly corner of said lands of DeVoe; thence through said lands of DeVoe, in part along the Southeasterly limit of existing Zoning District C-1 Commercial, in a generally Southwesterly direction approximately 540 feet to a point in the Northeasterly margin of U.S. Route 9; thence along said Northeasterly margin in a generally Southeasterly direction approximately 1360 feet to the Northwesterly corner of the above mentioned lands of Shaffer and the point or place of beginning, containing approximately 36.5 acres of land.

There shall be constructed within the area of said Planned Development District No. 7, the improvements set forth on a site plan entitled, "Proposed Commercial-Industrial Planned Development District, Town of Halfmoon, Saratoga County, New York," made by G. Alan Cruickshank, Professional Land Surveyor, and dated November 1976, and setting forth, in general, a proposed land use of business-commercial-industrial facilities.
A. 
All construction shall be designed and constructed pursuant to plans and specifications prepared under the direction of a duly-licensed architect, professional engineer or land surveyor, as applicable, in strict compliance with the New York State Building Code. The plans and specifications shall be approved by the Town Planning Board and, upon approval by the Town Planning Board, immediately thereafter shall be filed in the Office of the Town Clerk. All construction shall be performed subject to the direction and control of a duly-licensed architect, professional engineer and/or land surveyor, as applicable, and when completed shall be certified to the Town Building Inspector as having been constructed in full compliance with the New York State Building Code and with the plans and specifications as approved by the Town Planning Board. The architect, professional engineer or land surveyor performing the work herein described shall be employed by and at the sole expense of the developer. All construction, during performance thereof and upon completion, shall be subject to the inspection and approval of the Town Building Inspector. No use shall be made of any land within such planned development district unless such use is permitted by and under the local law relating to zoning for the Town of Halfmoon.
B. 
The Planning Board may provide for and require such performance bond or bonds as it may deem reasonable.
Private sewage and water systems must and shall be connected to public or municipal facilities when available and at no cost to the Town of Halfmoon. The developer may not proceed prior to approval by the appropriate regulatory agencies relating to water supply and sewage treatment facilities.
This amendment shall be deemed automatically revoked and void and the previous regulations shall obtain if, within 24 months from the effective date of this local law, commencement of the construction of the development has not begun or if, after construction has begun, substantial progress does not continue without undue interruption thereafter. In the event that extensions are required, a request must be made in writing to the Town Board of the Town of Halfmoon. Any such extension of time may be made by the Town Board without a public hearing.
RESOLUTION OF A TOWN BOARD MEETING OF THE TOWN OF HALFMOON

WHEREAS, Jaclyn Beacon Realty, Inc., as owner and contract vendor and Vincent T. Riggi, Jr., as contract vendee, have requested that Local Law No. 1-1977, enacted in April 1977 and extended by resolution of the Town Board dated February 7, 1984 regarding real property formerly owned by G. Alan Cruickshank and Key Bank, N.A., which property was previously known as Corporate Park and is now designated as Town Plaza, located on Route 9 in the Town of Halfmoon, be granted an additional extension of time for the use contemplated by Local Law No. 1-1977.
NOW, THEREFORE, it is:
RESOLVED, that the Town of Halfmoon hereby grants an extension of an additional two years from February 7, 1986 to February 7, 1988 for the use of the zoning as described in Local Law No. 1-1977.
