It is determined and declared that the use of family or private swimming
pools in the Borough of Haddon Heights without appropriate precautionary safety
measures constitutes a hazard to the safety of the residents of this Borough,
particularly children.
As used in this chapter, the following terms shall have the meanings
indicated:
BOROUGH
The Borough of Haddon Heights.
PERSON
An individual, firm, partnership or corporation.
RECONSTRUCTION
The replacement, alteration of or addition to an existing swimming
pool, but not including equipment.
SWIMMING POOL
Any private swimming pool, tank or other device which is artificially
constructed to provide outdoor recreational facilities for swimming, bathing
or wading, whether of permanent construction or portable in nature, upon any
premises, for the use of the occupants of said premises and their guests,
which has a depth at any point in excess of 15 inches or a capacity of 300
gallons or more, and whether said pool be below ground level, above ground
level or partly above and partly below ground level.
The Building Inspector or such other person as may be designated from
time to time by resolution of Borough Council shall enforce the provisions
of this chapter and, to that end, shall make periodic inspections of all swimming
pools.
No swimming pool constructed, installed, relocated or reconstructed
pursuant to a permit obtained hereunder shall have any water put into it or
be put in use until the Building Inspector or other person charged with enforcement
hereof shall have inspected and approved the same, by appropriate endorsement
on such permit, as complying herewith.
The location of a swimming pool shall be in accordance with the requirements of Chapter
450, Zoning and Land Development.
There shall be no physical connection between a pool and a potable water
supply below the maximum water level of the pool, nor to a recirculating or
heating system of a pool, unless such physical connection is so installed
and operated that no pool water can be discharged or siphoned into a potable
water supply system.

Every swimming pool hereafter constructed or installed shall be completely
enclosed by a fence or wall of durable construction having at least one gate
or door of equally durable construction. All gates and doors opening through
such enclosure shall be equipped with self-closing and self-latching devices
at least three feet above ground level, so designed as to keep such gates
and doors securely closed when not in use. The fence or wall shall be so constructed
as to prevent any person from gaining access beneath or through such fence
or wall except by a gate or door as described above. All such gates and doors
shall be kept closed at all times except when open for the purpose of ingress
and egress. No portion of the fence or wall shall be installed less than three
feet from the nearest point of the water in the pool. A residence or other
permanent building may form part of the fence or wall.
The owner or other person in possession of any swimming pool shall allow
any person charged with the enforcement hereof or any representative of the
Haddon Heights Board of Health to inspect the same at reasonable times.
Within 60 days after passage hereof:
B. All such pools shall be fenced in the manner prescribed by §
407-8; provided, however, that such fence shall not be required if there is a platform at least two feet in width completely around the pool and the outside edge of such platform is at least 3 1/2 feet from every point of the ground and the usual means of access is either securely fenced or otherwise so constructed as to be equally secure.
All swimming pools hereafter constructed, installed, relocated or reconstructed
shall be so situated that normal surface water will drain away from the pool.
No drain of a swimming pool shall be connected with or permitted to drain
into the sanitary sewer system; nor shall any such pool be physically connected
with any storm drain system, but such latter system shall be used, wherever
feasible, to receive the drainage.
All existing and hereafter constructed, installed, relocated or reconstructed
swimming pools shall be maintained and operated in such manner as to be clean
and sanitary at all times.
Existing swimming pools and those reconstructed, relocated or installed
or hereafter constructed shall be so maintained and operated as to not cause
annoyance to persons off the premises in question. Artificial lighting used
in connection with any such pools shall be so located as to not be an annoyance
to such persons.
A permit issued hereunder shall be in lieu of a building permit, but
the Building Code of the Borough of Haddon Heights shall be otherwise applicable
to the extent that it would be appropriate.
This chapter shall not be construed as to nullify the regulations of
the Haddon Heights Board of Health or the provisions of any other Haddon Heights
code or ordinance, except as expressly or by necessary implication modified
hereby.
