A. Any person may make written request to the Township police to warn
any owner, keeper or custodian of any dog which disturbs the peace
by barking, howling, yelping, or making other loud noises to the annoyance,
discomfort, and/or health of persons and/or residents in the Township
of Upper Pottsgrove.
B. A warning by the police shall consist of delivery of a copy of this
provision and/or a written notice to any such owner, keeper or custodian
in person or by registered mail.
C. Failure of such owner, keeper or custodian to correct or abate such
condition after warning shall be a violation of this article and shall
hereby be declared a nuisance.
An owner, keeper or custodian shall comply with
the following regulations:
A. All dogs and dog quarters shall be kept in a clean
and sanitary condition. Adequate ventilation shall be provided.
B. No dog shall be teased, abused, mistreated, annoyed,
tormented or otherwise made to suffer.
C. Odors attributable to a dog shall not be permitted
to be perceptible beyond the premises where it is kept.
D. No dog shall be permitted to bark, whine or howl continuously
to the extent that it is perceptible beyond the property of the owner,
keeper or custodian for a period of more than 15 minutes.

E. There shall be adequate provision and safeguard to
control the dog so that it does not cause damage to property or injury
to a person. The failure to control a dog at the time it damages property
or causes injury to a person is a violation of this provision by the
owner, keeper or custodian.
F. No owner or person having custody of such dog or dogs shall harbor
it or permit it to commit a nuisance as defined by this ordinance.

Any person, firm or corporation who shall violate
any provision of this article shall be sentenced to pay a fine of
not more than $600 and costs, or to imprisonment for a term not to
exceed 30 days.
