The Town Council may deny, revoke or refuse
to renew any license issued under this chapter upon the grounds that
the activity presents a danger to the public health or safety.
The Town Council may authorize the performance
for pay or profit of vocal, instrumental or orchestral entertainment
and lectures of an instructive character, the operation of amusement
parks, the operation of a miniature golf course, and vaudeville performances
of juggling and stage dancing having the approval of the Chief of
Police, and moving picture exhibitions consisting of such pictures
as have the approval of the National Board of Review and the Chief
of Police, on Sunday(s) during such hours of the day as the Town Council
shall determine.
The Town Council may also appoint proper officials,
at the expense of the licensee, to preserve order and execute the
orders of the Town Council at any such show and to report to the Chief
of Police of the Town any violation of the law.
A license under this chapter shall not be issued
until the building to be used for the show, together with the apparatus
to be used, has been inspected by the Town Building Official and the
Town Building Official has stated, in writing, that the building and
apparatus meets Chapters 29, 30 and 35 of Title 23 of the Rhode Island
General Laws and is otherwise safe. If the building or apparatus does
not meet the foregoing requirements, then no license shall be issued
and, if any license was issued, said license shall be void.
Any person who violates this chapter shall be
fined not exceeding $500 or imprisoned for not exceeding one year,
or shall be punished by both fine and imprisonment.
